Article 7 — Parking Pay Stations

§ 4-4.701. State Vehicle Code Provisions.

All of the provisions of this article concerning the parking of vehicles and the regulation of the parking of vehicles by the use of parking pay stations are expressly enacted under the Constitution of the State, Article XI, Section 11, together with the provisions of the California Vehicle Code, including, but not limited to, Vehicle Code Section 22508, as that section may be amended from time to time. The provisions set forth in the California Vehicle Code shall govern whenever this article fails to set forth any specific provisions. (Ord. 12-787A, § 3)

§ 4-4.702. Definitions.

For the purpose of this article, certain words and phrases are defined and certain provisions shall be construed as provided below, unless it is apparent from the context that a different meaning is intended.

"Coin" means any lawful coin or combination of coins of the United States of America as designated by the legend on the parking pay station.

"Downtown business operator" means an owner, operator or manager of a business located on Pioneer Boulevard or within one block thereof and southerly of 183rd Street and northerly of the City's southern border who can provide proof to City staff of owning, operating or managing a business within that area.

"Operator" means and includes every individual who shall operate a vehicle as the owner, or as the agent, employee or permittee of the owner, or who is in actual physical control of the vehicle.

"Parking pay station" means and includes any device that has mechanical and electric components into which payment for parking in a defined space is deposited as required by this article.

§ 4-4.703. Designation of Pay Station Numbered Spaces.

The Traffic Engineer is authorized and empowered to: (a) mark off individual parking spaces in all parking pay station zones, which spaces shall be designated by lines painted or durably marked on the surface of the street or on the curb; and (b) assign and apply a pay station number adjacent to each parking space that corresponds with the parking place identified in the applicable pay station.

§ 4-4.704. Installation of Parking Pay Stations.

  • (a) Street Parking Pay Stations. The Traffic Engineer is authorized and empowered to install parking pay stations upon the curb or sidewalk on the same side of the street for those parking spaces along the streets designated in Section 4-4.711. Each parking pay station shall display a code, letters or a signal showing parking is allowed for a specific number of minutes or hours upon the deposit of appropriate coin and using a key pad to identify the space number. The pay station shall also indicate by signal, code or letters when the lawful parking period has expired. No parking pay station shall be capable of registering permitted parking time in excess of the time limit established by the Traffic Engineer.

  • (b) Parking Lot Pay Stations. The Traffic Engineer is authorized and empowered to designate locations for and install parking pay stations within the City's parking lot designated in Section 4-4.712. Each parking pay station shall display a code, letters or a signal showing parking is allowed for a specific number of minutes or hours upon the deposit of appropriate coin and using a key pad to identify the space number. The pay station shall also indicate by signal, code or letters when the lawful parking period has expired. No parking pay station shall be capable of registering permitted parking time in excess of the time limit established by the Traffic Engineer.

§ 4-4.705. Installation of Parking Pay Station Signage.

The Traffic Engineer, or designee, is directed to install standard and required signage indicating parking pay station restrictions in all parking pay station zones. (Ord. 12-787A, § 3)

§ 4-4.706. Maintenance of Parking Pay Stations.

The Traffic Engineer and the City's contract pay station provider shall be responsible for the maintenance and operation of the parking pay stations. (Ord. 12-787A, § 3)

§ 4-4.707. Reservation of Powers.

Nothing in this article shall be construed as prohibiting the Traffic Engineer from converting a parking space in a parking pay station zone to an area for a pedestrian crosswalk, bus stop, and taxicab stand and other use, including the loading and unloading of trucks, vans, and other commercial vehicles. Nothing in this article shall be construed as prohibiting the Traffic Engineer from establishing maximum parking time limits. (Ord. 12-787A, § 3)

§ 4-4.708. Enforcement.

It shall be the duty of Traffic Enforcement officers to enforce the provisions of this article. (Ord. 12-787A, § 3)

§ 4-4.709. Collection.

The City's Code Enforcement officers, Traffic Enforcement officers, or other City personnel designated by the City Manager shall be authorized to make regular collections of the money deposited in the parking pay stations and to deliver the money to the Finance Director, or designee, who shall count and deposit the funds into the City's Treasury. § 4-4.710. Parking Pay Station Zones.

The City shall be divided into the following parking pay station zones and each zone shall be subject to the rules and regulations established for that zone, as set forth below. (Ord. 12-787A, § 3)

§ 4-4.711. Parking Pay Station Zone A—"Zone A-Street Parking Pay Station Zone."

  • (a) The following named and described streets or portions of streets within the City shall constitute "Zone A-Street Parking Pay Station Zone":

    • (1) The north and south side of 186th Street between Pioneer Boulevard on the west and Arline Avenue on the east.

    • (2) The north and south side of 187th Street between Pioneer Boulevard on the west and the first alleyway on the east.

    • (3) The north side of 186th Street between Pioneer Boulevard on the east and Corby Boulevard on the west.

    • (4) The south side of 186th Street between Pioneer Boulevard on the east and the first alleyway on the west.

    • (5) The east side of Corby Avenue between 186th Street on the south and the north property line of the City parking lot on the north.

    • (6) The north and south side of 187th Street between Pioneer Boulevard on the east and the first alleyway on the west.

    • (7) The west side of Pioneer Boulevard between the Los Angeles County Metropolitan Transportation Authority right-of-way on the north and 188th Street on the south.

    • (8) The north and south sides of 187th Street between the alley west of Pioneer Boulevard and Corby Avenue.

  • (b) Parking rates for parking a vehicle in a designated space in parking pay station "Zone A- Street Parking Pay Station Zone" shall be one dollar fifty cents ($1.50) per hour.

  • (c) Parking pay stations shall be operated in "Zone A-Street Parking Pay Station Zone" at such times and hours as posted by the Traffic Engineer.

§ 4-4.712. Parking Pay Station Zone B—"Zone B-Parking Lot Pay Station Zone."

  • (a) The City parking lot on the northeast corner of 186th Street and Corby Avenue shall constitute "Zone B-Parking Lot Pay Station Zone."

  • (b) Parking rates for parking a vehicle in a designated space in parking pay station "Zone B- Parking Lot Pay Station Zone" shall be one ($1.00) dollar per hour, unless the vehicle is displaying a downtown business operator parking permit.

  • (c) Downtown Business Operator Parking Permit.

    • (1) City staff is authorized to establish a system of downtown business operator parking permits for purposes of allowing downtown business operators and their employees to park in Zone B-Parking Lot Pay Station Zone for extended periods of time without depositing money into the pay stations in Zone B-Parking Lot Pay Station Zone.

    • (2) Downtown business operators and their employees shall provide proof that they are a downtown business operator or employee and submit an application for a permit on the form designated by the Administrative Services Manager.

    • (3) Downtown business operators and their employees shall pay a downtown business operator parking permit fee. The City Council shall establish fees for the issuance of initial, renewal, transfer and replacement of downtown business operator parking permits.

    • (4) City staff shall issue downtown business operator parking permits quarterly, on a first-come, first-serve basis, not to exceed the available spaces in the Zone B-Parking Lot Pay Station Zone.

  • (d) Parking pay stations shall be operated in "Zone B-Parking Lot Pay Station Zone" at such times and hours as posted by the Traffic Engineer.

§ 4-4.713. Parking Pay Station Zone C—Reserved.

§ 4-4.714. Violations.

It is unlawful and a violation of the provisions of this article for any person to violate the provisions of Sections 4-4.715 through 4-4.722.

§ 4-4.715. Parking Beyond Designated Space.

It is a violation to park any vehicle across any line or marking of a parking pay station space or in such a position that the vehicle shall not be entirely within the area designated by such lines or markings.

§ 4-4.716. Operation of Parking Pay Stations.

  • (a) Unless exempt pursuant to Subsection (b), (c) or (d) of this section, when any vehicle shall be parked in any parking pay station space, the operator immediately shall deposit payment in the manner prescribed on the parking pay station. Payment may be made by coins or credit card as designated by signage on the parking pay station. Unless otherwise permitted by law, no person shall park a vehicle in a designated parking pay station space in excess of the maximum parking time limit set by the Traffic Engineer, or designee.

  • (b) Subsection (a) of this section shall not require an operator of a vehicle to deposit payment in a parking pay station when:

    • (1) The parking pay station indicates an unexpired portion remains of the period for which payment had been previously made; or

    • (2) An officer of the Fire or Police Department has determined a period of emergency exists; or

    • (3) In compliance with the directions of a police officer or traffic control sign or signal.

  • (c) Subsection (a) of this section shall not require an operator of a vehicle to deposit payment in a parking pay station if the vehicle is lawfully displaying a disabled person or disabled veteran placard, pursuant to Vehicle Code Section 22511 issued by the California Department of Motor Vehicles.

  • (d) Subsection (a) of this section shall not require an operator of a vehicle to deposit payment in a parking pay station in Zone B-Parking Lot Pay Station Zone if the vehicle is lawfully displaying a down-town business operator parking permit. A downtown business operator parking permit shall not exempt the vehicle operator from having to deposit payment in any other parking pay station zone and such permits shall not be applicable in the Zone A-Street Parking Pay Station Zone.

§ 4-4.717. Parking Beyond Time Limit.

It is a violation to cause, allow, permit or suffer any vehicle registered in the name of, or operated by such person to be parked overtime, or beyond the period of legal parking time established for any parking pay station zone as herein described, or to deposit in any parking pay station any coin for the purpose of parking beyond the maximum legal parking time for the particular parking pay station zone.

§ 4-4.718. Failure to Remove Vehicle within Posted Time Limit Period.

No owner or operator of a vehicle shall cause the vehicle to remain in a City owned or operated parking spot beyond the period of time allowed that is specified on posted signs. (Ord. 12-787A, § 3)

§ 4-4.719. Parking When Parking Pay Station Indicates Time Limit is Over.

It is a violation to permit any vehicle to remain or be placed in any parking space adjacent to any parking pay station beyond the time permitted or when the pay station indicates the paid time period has expired.

§ 4-4.720. Damaging Parking Pay Stations.

It is a violation to deface, injure, tamper with, open or willfully break, alter, destroy, or impair the usefulness of any parking pay station installed or provided under the provisions of this article. (Ord. 12-787A, § 3)

§ 4-4.721. Slugs.

It is a violation to deposit or cause to be deposited in any parking pay station any slugs, device or metal substance, or other substitute for lawful coins. (Ord. 12-787A, § 3)

§ 4-4.722. Civil Penalties.

Notwithstanding any other provision of this Code to the contrary, violation of Sections 4-4.715 through 4-4.721 of this Code shall be punishable by the following civil penalties:

(a) If payment is made within the time set forth in the notice of citation of violation or as provided for by law, not less than $40 shall be assessed.

  • (b) If no payment or request for administrative review is made as provided for by law, after notice of delinquency is issued, in the manner required by law, not less than $23 shall be assessed in addition to the underlying assessment.
