13.82.010 - Purpose of chapter.¶
The purpose of this chapter is to establish a procedure for allocating remaining capacity in the city's wastewater treatment facility among the various uses of land allowed within the city and authorizing a moratorium on the development of certain types of uses if and when the allocation for a particular type of use is exhausted. It has become necessary to establish such a procedure due to the definitive capacity remaining in the wastewater treatment facility. In order to promote and maintain a balanced growth to uses within the city it is necessary to allocate the remaining capacity among such uses.

13.82.020 - Allocation authorized.¶
Whenever the city council finds that, based upon a report by the city's public works director, the wastewater entering the treatment facility exceeds seventy percent of total plant capacity, the council may adopt by resolution a plan for allocating the remaining capacity among specific categories of new uses within the city. A resolution adopting such plan must include a finding that the allocation being made is in conformity with the provisions of the land use element of the general plan and, in particular, that such allocation will not create an imbalance of uses as is prescribed in the general plan.

13.82.030 - Moratorium on new development.¶
Whenever the allocations for a particular type of use or for a particular zone, as the case may be, are exhausted, the council may by resolution establish a moratorium on the issuance of building permits for such use or for all cases within such zone. Such moratorium shall remain in effect until modification of or expiration of the sewer allocation plan then in effect.
