1.04.010 - Definitions.

In the construction of this code and of all ordinances of the city, the following rules shall be observed, unless such construction would be inconsistent with the manifest intent of the city council or the context clearly requires otherwise:

  1. "The city" or "this city" shall be construed as if followed by the words "of Anderson."

  2. "The code" or "this code" means the Anderson Municipal Code, 1975.

  3. "Computation of time." The time in which any act provided by law is to be done is computed by excluding the first day and including the last, unless the last day is a holiday and then it is also excluded.

  4. "Construction standards," as used in this code means published construction specifications, design criteria, guidelines, plan submittal requirements, construction criteria and standard plans. Construction Standards are prepared by the public works director and shall be filed with the city clerk and the public works director on a bi-annual basis. The construction standards provide guidelines and minimum standards that shall be applied to the design and construction of streets, alleys, paths, bikeways, signing, pavement delineation, grading, storm drainage, storm water treatment facilities, sanitary sewers, domestic water, fire service, landscaping, erosion control, street lighting, utility box and vault locations, open space access, right-of-way fencing, trash enclosures, drafting and design presentation and other instructional items deemed necessary by the public works director to guide and regulate improvements of land.

  5. "Council" means the city council of Anderson.

  6. "The county" or "this county" means the county of Shasta.

  7. "Day" means the period of time between any midnight and the midnight following.

  8. "Daytime, nighttime." "Daytime" means the period of time between sunrise and sunset. "Nighttime" means the period of time between sunset and sunrise.

  9. "In the city" means and includes all territory over which the city now has or shall hereafter acquire jurisdiction for the exercise of its police powers or other regulatory powers.

  10. "Joint authority." All words giving a joint authority to three or more persons or officers shall be construed as giving such authority to a majority of such persons or officers unless otherwise specified.

  11. "Month" means a calendar month.

  12. "Oath" includes affirmation.

  13. "Officer, department, board, commission." Every officer, department, board, commission or similar body mentioned in this code means an officer, department, board, commission or similar body of the city of Anderson, unless otherwise specified.

  14. "Official time." Whenever certain hours are named in this code, they mean Pacific Standard Time or Daylight Saving Time as may be in current use in the city.

  15. "Operate" includes carry on, keep, conduct or maintain.

  16. "Or, and." "Or" may be read "and," and "and" may be read "or," if the sense requires it.

  17. "Person" includes any person, firm, association, organization, partnership, business trust, corporation or company.

  18. "Personal property" includes every species of property except real property as defined in subsection 20.

  19. "Preceding, following." "Preceding" and "following" mean next before and next after, respectively.

  20. "Property" includes real and personal property.

  21. "Real property" includes lands, tenements and hereditaments.

  22. "Shall, may." "Shall" is mandatory and "may" is permissive.

  23. "Signature" or "subscription" includes a mark when the signer or subscriber cannot write, such signer's or subscriber's name being written near the mark by a witness who writes his own name near the signer's or subscriber's name. A signature or subscription by mark can be acknowledged or can serve as a signature or subscription to a sworn statement only when two witnesses so sign their own names thereto.

  24. "The state" or "this state" means the state of California.

  25. "Street" includes all streets, highways, avenues, lanes, alleys, courts, places, squares, sidewalks, parkways, curbs or other public ways in the city which have been or may hereafter be dedicated and open to public use, or such other public property so designated in any law of this state.

  26. "Tenant" or "occupant," applied to a building or land, includes owners or any person holding a written or an oral lease of or who occupies the whole or a part of such building or land, either alone or with others.

  27. "Week" means seven consecutive days.

  28. "Writing" includes any form of a recorded message capable of comprehension by ordinary visual means. Whenever any notice, report, statement or record is required or authorized by this code, it shall be made in writing in the English language, unless it is expressly provided otherwise.

  29. "Year" means a calendar year, except where otherwise provided.

1.04.020 - Grammatical interpretation.

A. Gender. The masculine gender includes the feminine and neuter.

B. Number. The singular number includes the plural, and the plural includes the singular.

C. Tenses. The present tense includes the past and future tenses, and the future includes the present.

1.04.030 - Unlawful acts or omissions include causing, permitting or aiding.

Whenever in this code any act or omission is made unlawful, it shall include causing, permitting, aiding, abetting, suffering or concealing such act or omission.

1.04.040 - Acts by deputy.

Whenever a power is granted to or duty is imposed upon a public officer or employee, the power may be exercised or the duty may be performed by a deputy of such officer or employee or by a person otherwise duly authorized, pursuant to law or ordinance, or by an officer when by contract with the city such officer is obligated and has agreed to perform certain duties on behalf of the city, unless this code expressly provides otherwise.

1.04.050 - Notice—Service.

Whenever a notice is required to be given under this code, unless different provisions herein are otherwise specifically made, such notice may be given either by personal delivery thereof to the person to be notified or by deposit in the United States mail in a sealed envelope, postage prepaid, addressed to such person to be notified at his last known business or residence address as the same appears in the public records of the city or other records pertaining to the matter to which such notice is directed. Service by mail shall be deemed to have been completed at the time of deposit in the post office.

1.04.060 - Notice—Proof.

Proof of giving any notice may be made by the certificate of any officer or employee of the city, or by affidavit of any person over the age of eighteen years which shows service in conformity with this code or other provisions of law applicable to the subject matter concerned.
