6.56.010 FENCE REQUIRED — SPECIFICATIONS.¶
.010 Any swimming pool, ponds or other body of water on private property designed or intended to contain water more than eighteen inches in depth at any point, shall be enclosed by a barrier adequate to prevent entry of small children. The solid walls of a fence, dwelling, building or structure may constitute a part of the barrier. Such barriers, fences and walls shall comply with Sections 419, 420 and 421 of the Appendix of the most current edition of the Anaheim Building Code.
.020 Compliance. No pool or pond subject to this chapter shall be plastered or filled with water until the Building Official has determined that the provisions of this chapter have been met.
.030 Exceptions to the requirements of this section shall be as set forth in the most current edition of the Anaheim Building Code. 6.56.020 USE OF GUARD IN LIEU OF FENCE.¶
In lieu of maintaining a fence or wall as above set forth, there may be provided a competent person who shall keep the pool or other body of water under observation at all times while water is kept therein. In the event the pool or other body of water is not under the observation of a competent person, a pool cover or similar protective device approved by the City Council may be used. 6.56.030 TIME FOR COMPLIANCE WITH CHAPTER.¶
All persons maintaining such pools shall comply with the provisions of this chapter within ninety days after the effective date of this chapter. (Ord. 1177 (part); December 10, 1957; Section renumbered by Ord. 1203; January 7, 1958.)
6.56.040 VARIATION OF REQUIREMENTS.¶
The City Council may make slight modifications for good cause shown in individual cases, with respect to the height of the fence or the nature or position of the latch. The City Council may permit other protective devices or structures to be used so long as the degree of protection afforded by the substitute devices or structures is not less than the protection afforded by the fence, gate and latch described herein. Upon the application of a property owner, the City Council may grant extensions of time for compliance, for good cause shown in individual cases. Such extensions of time shall not exceed thirty days at a time. (Ord. 1177 (part); December 10, 1957; Section renumbered by Ord. 1203; January 7, 1958.)
6.56.050 CLARITY OF WATER.¶
The recirculation and purification system shall be operated and maintained so as to keep the pool water clean and clear. Under no circumstances shall the pool be used when a black disc, six inches in diameter, on a white field, when placed at the bottom of the pool at the deepest point is not clearly visible from the sidewalks of the pool at all distances up to ten yards from such discs. Such a pool shall be closed and shall not be reopened until the water is clean and clear, and upon specific approval of the Health Officer. (Ord. 3440 § 1 (part); June 24, 1975.)
6.56.060 CLEANLINESS OF POOL.¶
Floating scum, sputum, and debris shall not be allowed to accumulate in the pool; skimmers, where provided, and water levels shall be maintained and operated to continuously remove such material. The bottom and sides of the pool shall be cleaned as often as necessary to keep in a clean condition. The sides and bottom of pools, decks, and other surfaces shall be kept free of slime and algae to prevent unnecessary slipperiness and danger of accidents or drownings. 6.56.070 ENFORCEMENT.¶
When a private swimming pool becomes foul or stagnant through lack of maintenance as described in the above sections, the Health Officer and/or Building Official shall notify the owner in writing to abate the hazard within forty-eight hours. Failure to comply within specified time shall be a misdemeanor. (Ord. 3440 § 1 (part); June 24, 1975.)
6.56.080 SWIMMING POOL DRAINAGE.¶
It shall be unlawful for any person to drain a swimming pool, upon the property of another or upon or into any public property other than into a sanitary sewer. (Ord. 3907 § 4; September 5, 1978.)
