§ 1.04.010 CITATION OF CODE.¶
The ordinances embraced in the following chapters and sections shall constitute and be designated the “Alhambra Municipal Code,” of the City of Alhambra, California, and may be so cited.

§ 1.04.020 DEFINITIONS GENERALLY.¶
In the construction of this code and of all ordinances of the city, the following rules shall be observed, unless such construction would be inconsistent with the manifest intent of the City Council or the context clearly requires otherwise.

§ 1.04.030 CITY.¶
THE CITY or THIS CITY shall be construed as if followed by the words “of Alhambra.”

§ 1.04.040 CODE.¶
THE CODE or THIS CODE shall mean the “Alhambra Municipal Code,” of the City of Alhambra, California.

§ 1.04.050 COUNCIL.¶
COUNCIL or CITY COUNCIL shall be construed to mean the City Council of the City of Alhambra.

§ 1.04.060 COMPUTATION OF TIME.¶
The time in which any act provided by law is to be done is computed by excluding the first day and including the last unless the last day is a holiday and then it is also excluded.

§ 1.04.070 COUNTY.¶
THE COUNTY or THIS COUNTY shall mean the county of Los Angeles of this state.

§ 1.04.080 DAY.¶
DAY means the period of time between any midnight and the midnight following.

§ 1.04.090 DAYTIME, NIGHTTIME.¶
DAYTIME means the period of time between sunrise and sunset. NIGHTTIME means the period of time between sunset and sunrise.

§ 1.04.091 CITY DEPARTMENTS.¶
The following departments shall operate within the city for the management and operation of the city’s functions:
(A) Management Services Department.
(B) Department of Parks and Recreation.
(C) Department of Finance.
(D) Department of Public Works and Utilities.
(1) Whenever hereinafter in this code the words “Public Works Department,” or “Department of Public Works,” or “City Public Works Department,” or “Public Works,” or “City Department of Public Works,” or “City of Alhambra Public Works Department,” or “Department of Public Services” are used, the words “Department of Public Works and Utilities” shall be substituted in lieu thereof.
(2) Whenever hereinafter in this code the words “Water Division of the Department of Public Works,” or “Utilities Department,” or “Water Division of the Department of Public Services,” or “Water Department,” are used, the words “Department of Public Works and Utilities” shall be substituted in lieu thereof.
(E) Community Development Department.
(F) Fire Department.
(G) Human Resources Department. Whenever hereinafter in this code the words “Personnel Department” or “Personnel Office” are used, the words “ Human Resources Department” shall be substituted in lieu thereof.
(H) Library.
(I) Police Department.

§ 1.04.100 GENDER.¶
The masculine gender includes the feminine and neuter.

§ 1.04.110 IN THE CITY.¶
IN THE CITY includes all territory over which the city now has, or shall hereafter acquire the jurisdiction for the exercise of its police powers or other regulatory powers.

§ 1.04.120 JOINT AUTHORITY.¶
All words giving a joint authority to three or more persons or officers shall be construed as giving such authority to a majority of such persons or officers.

MONTH means a calendar month.

The singular number includes the plural, and the plural the singular.

The term OR may be read “and,” and the term AND may be read “or,” if the sense requires it.

§ 1.04.170 OWNER.¶
OWNER applied to a building or land, shall include any part owner, joint owner, tenant in common, tenant in partnership, joint tenant or tenant by entirety, of the whole or of a part of such building or land.

§ 1.04.180 PERSON.¶
PERSON includes any person, firm, association, organization, partnership, business trust, corporation or company.

§ 1.04.190 PERSONAL PROPERTY.¶
PERSONAL PROPERTY includes every species of property except real property, as defined in this chapter.

PRECEDING and FOLLOWING mean next before and next after, respectively.

§ 1.04.210 PROCESS.¶
PROCESS includes a writ or summons issued in the course of judicial proceedings of either a civil or criminal nature.

PROPERTY includes real and personal property.

ROADWAY Is that portion of a highway improved, designed or ordinarily used for vehicular travel.

The term “shall” is mandatory and the term “may” is permissive.

SIDEWALK Is that portion of a highway, other than the roadway, set apart for pedestrian travel.

§ 1.04.270 SIGNATURE OR SUBSCRIPTION.¶
SIGNATURE or SUBSCRIPTION includes a mark when the signer or subscriber cannot write, such signer's or subscriber's name being written near the mark by a witness who writes his own name near the signer's or subscriber's name; but a signature or subscription by mark can be acknowledged or can serve as a signature or subscription to a sworn statement only when two witnesses so sign their own names thereto.

§ 1.04.280 STATE.¶
THE STATE or THIS STATE shall be construed to mean the state of California.

§ 1.04.290 STREET, HIGHWAY.¶
STREET or HIGHWAY is a way or place of whatsoever nature, publicly maintained and open to the use of the public for purposes of vehicular travel.

§ 1.04.300 TENANT OR OCCUPANT.¶
TENANT or OCCUPANT, applied to a building or land, shall include any person holding a written or oral lease of or who occupies, the whole or a part of such building or land, either alone or with others.

§ 1.04.310 TENSES.¶
The present tense includes the past and future tenses; and the future, the present.

A week consists of seven consecutive days.

WRITING includes any form of recorded message capable of comprehension by ordinary visual means. Whenever any notice, report, statement or record is required or authorized by this code, it shall be made in writing in the English language unless it is expressly provided otherwise.
