25-4.1 - Leave of Absence Without Pay.

An appointing authority shall have the power to grant a leave of absence without pay to any officer or employee of the City for a period of time not to exceed six (6) months; provided, however, that if such officer or employee is within the Civil Service System of the City, approval of the Civil Service Board must be first had and obtained. This subsection shall not contravene or diminish any power of the Civil Service Board to grant a leave of absence under any other City ordinance.

25-4.2 - Death or Illness in Immediate Family.

Whenever any officer or employee is compelled to be absent from duty by reason of death, or critical illness where death appears imminent, of either father, mother, brother, sister, husband, wife, child, grandchild, or a relative who lives in the place of residence of such officer or employee, or of the father or mother of the spouse of such officer or employee, such officer or employee shall receive compensation during such absence at the regular rate of pay for time necessary to be absent from work, not, however, to exceed three (3) working days in all; provided, that, the compensation herein provided to be paid shall be paid only when the officer or employee absent shall furnish satisfactory evidence of the facts justifying such absence.

25-4.3 - Military Leaves of Absence.

a. Compensation Limited. Any officer or employee of the City who is granted a leave of absence for service in the military, naval or marine service of the United States or of the State of California, and who has been in the employ of the City for six (6) months or more immediately preceding the date from which such leave begins, shall be allowed his/her regular salary or compensation for a period of not more than one (1) month in any calendar year or during any continuous leave of absence. The compensation payable to such officer or employee on leave, as provided in this subsection, whose regular compensation paid by the City is based on a per them or hourly basis, shall be an amount equal to the average monthly compensation received by such period during the six (6) months immediately prior to such leave of absence. The provisions of this subsection and subsection 11-3.1 shall not be cumulative.

b. Statutory Provisions. Every officer and employee shall be entitled to such leaves of absence with pay and other benefits as are provided in Division 2, Part 1, Chapter 7, Paragraph 395, of the Military and Veterans Code of the State of California.
