15-6.1 - Regulating Operation of Gasoline, Benzine and Flammable Liquid Dispensing Devices.

a. Gasoline, benzine and other flammable liquids, articles and like products shall be delivered only from pumps or other dispensing devices which have been approved by the Chief of the Fire Department. Each automotive fuel service station open and catering to the public shall have a regular attendant or supervisor on duty continuously thereat during all times such station is open for the sale or dispensing of such liquids, articles and products.

b. Approved special type dispensers or dispensing devices, such as remote preset types, are permitted at such service stations; provided, however, that the dispensing of Class I flammable liquid into any kind of portable container is prohibited at any service station at which such special type dispensers or dispensing devices are used.

c. This subsection shall also authorize and permit the operation of both self service type dispensing and regular full service type dispensing of Class I flammable liquids within an automotive service station. Such dual dispensing operations (self service and regular full service) may be permitted provided that:

  1. The self service dispensing of Class I liquids is under the continuous and constant observation and control of a competent attendant at all times;

  2. The self service attendant shall operate independently from the responsibilities of the regularly assigned full service attendant. The full service attendant likewise shall not share or assume the observation and control responsibilities of the self service dispensing attendant;

  3. The self service attendant shall at all times remain within thirty (30') feet of such self service dispensing operations or when approved special remote controlled devices are used, the self service attendant shall control these remote devices at a distance of not more than one hundred (100') feet from the furthest dispensing operations. In no case shall one (1) self service attendant be in the required control of more than six (6) dispensing operations simultaneously;

  4. Where remote controls are provided, there shall be an approved communications system installed between all pump islands and the control center. The communications from dispensing pumps to the self service attendant shall be at a level so that the customer can be heard distinctly at all times during the dispensing operation.

  5. There shall e an unobstructed view of the self service dispensing operation by the self service attendant. Displays, signs, or other obstructions interfering with his view are prohibited.

  6. When dispensing of Class I liquids at a dual dispensing type service station is available and open to the public, and dispensing operations may be done by a person other than the regular full service attendant, all station dispensing nozzles shall be a U.L. listed automatic closing type without a latch open device;

  7. Remote control devices and/or self service dispensing units shall be in an "OFF: position while not in use and must be activated by the self service attendant prior to public use. Emergency controls shall be installed at an approved location, and shall be not more than one hundred (100') feet from dispensers;

  8. No person other than a licensed vehicle operator may handle Class I liquid dispensing equipment, and instructions for the operation of dispensers shall be conspicuously posted;

  9. Dual type dispensing automotive service stations shall require a permit which shall be issued by the Chief of the Fire Department. Such a permit shall be issued if the intended dual operation conforms to all applicable requirements as specified by the Chief of the Fire Department.

e. This subsection does not authorize nor permit coin operated or card operated devices from which Class I flammable liquid is dispensed.
