13.24.010 - Title.

This chapter shall be known as the clean water protection fee for the unincorporated area of Alameda County.

13.24.020 - Purpose.

Urban stormwater runoff has been identified as one of the leading sources of pollutants in San Francisco Bay. In order to reduce this source of pollutants, the U.S. Environmental Protection Agency (EPA) finalized regulations in November, 1990 requiring Alameda County and its fourteen (14) cities to apply for a National Pollutant Discharge Elimination System (NPDES) permit pursuant to the federal Clean Water Act of 1972 and the Water Quality Act of 1987. The permit was mandated without federal funding.

The board of supervisors has determined that the program may be funded by the levy of a fee for service on each parcel of land located in the unincorporated area. Authorization for the fee is California Government Code Sections 25825, 25830, 54309, 54344 and other appropriate sections.

13.24.030 - Definitions.

Unless otherwise specifically provided or required by the context, the following terms have these meanings:

"Board of supervisors" or "board" means the board of supervisors of Alameda County, state of California.

"Director" means the director of the public works agency.

"Fee" means the clean water protection fee levied under this chapter.

"Parcel" means a parcel of real property as shown on the tax rolls of the county.

"Program" means the Alameda County urban runoff clean water protection program.

"Public works agency" means the public works agency of Alameda County.

"Report" means the annual report to be filed with the board of supervisors as described in Article II of this chapter.
