5.08.010 Definition.

“Yard Sale” or “Garage Sale,” for the purposes of this Chapter, shall mean any event which is advertised by any means whatsoever as a place or location to which members of the public may come and purchase identifiable or tangible personal property; provided, however, it shall not include any such event which constitutes a sales activity, wholesale or retail, by any business that holds a current business license issued by the City.

5.08.020 Permit Required - Issuance Conditions.

It shall be unlawful for any person, corporation, partnership, joint venture, association, or any other form of organization to organize, conduct, establish, or operate a yard sale or garage sale in the City without first obtaining a permit from the collector or his or her authorized representative.

The collector or his or her authorized representative shall issue a yard sale or garage sale permit to an applicant if all of the following conditions are met:

A. The operation or conduct of the requested event will not be contrary to the public peace, health, safety, and welfare of the City; and

B. The applicant has submitted satisfactory evidence that adequate and safe parking accommodations will be provided; and

C. The location at which the proposed yard sale or garage sale has not exceeded the maximum number of permitted sales as set forth in Section 5.08.030; and

D. The applicant has paid the application fee as provided in Section 5.08.040.

5.08.030 Permit - Duration and Frequency.

A. Any permit issued hereunder shall be for a period not exceeding five (5) consecutive calendar days from the date of issuance. A permittee shall not conduct a yard sale or garage sale for a period in excess of three (3) consecutive calendar days. All advertising carried on in conjunction with the sale shall be removed after completion of the sale.

B. A maximum of two (2) yard sales or garage sales per calendar month shall be permitted per residential property.

C. The maximum number of yard sales or garage sales permitted for any multi-family residence shall be one (1) per calendar year per occupied unit. Tenants of multi-family residences shall obtain written permission from the property owner prior to applying for a permit and shall submit such authorization at the time of application. Only the occupant of the multi-family residential unit shall be permitted to apply for and obtain a permit.

5.08.040 Permit - Application - Fee.

Application for a yard sale or garage sale permit shall be made to the City Clerk on forms provided by the City and shall be accompanied by a fee of ten dollars ($10.00) per permit, said fee to be used to defray the City’s expenses in processing the application. Permits shall be displayed at the site of the sale at all times during the permitted event.

5.08.050 Inspection.

All identifiable and tangible personal property exhibited for sale at a yard sale or garage sale shall be made accessible by the permittee to law enforcement officials at all times for review and inspection. During any such sale, the location shall be open to all fire prevention and health officers of the City for inspection to ensure compliance with City and State of California fire prevention and health regulations.

5.08.060 Misdemeanor.

Any person or organization that violates any provision of this Chapter shall be guilty of a misdemeanor, punishable by a fine not exceeding five hundred dollars ($500.00), imprisonment for a period not exceeding six (6) months, or by both such fine and imprisonment.
