Responsible agency

An agency other than the lead with a later discretionary approval over a project — it relies on the lead agency's CEQA document rather than starting over.

Definition

A responsible agency is a public agency, other than the lead agency, that has discretionary approval power over some part of a project — the Coastal Commission hearing a coastal permit appeal, a regional water board issuing permits, a state agency granting funding approvals. Under the CEQA statute it uses the lead agency's environmental document rather than preparing its own, making findings limited to the impacts within its authority as the CEQA Guidelines provide; it can demand a new document only in narrow circumstances.

Why it matters in an underwrite

Every responsible-agency approval is its own schedule item and its own challenge surface, keyed to the same environmental document. The sharper underwriting point: one stray discretionary permit anywhere in the chain — a tree removal, an encroachment, a coastal permit — keeps an otherwise ministerial project inside CEQA. Map the full permit list across all agencies before pricing a "no-CEQA" timeline.
