12.32.020 - Access.

The subdivider shall provide for access as provided in Section 12.36.050.

12.32.030 - Waiver of direct access rights.

The City may require as a condition of approval of a tentative map that dedications or offers of dedication of streets include a waiver of direct access rights to any such street from any property within or abutting the subdivision. Upon acceptance of the dedication, the waiver shall be shown on the final map, which shall be recorded.

12.32.040 - Dedications.

All dedications of property to the City for public purposes shall be made in fee title, except that, at the City's discretion, the grant of an easement may be taken for the following purposes: open space easement, emergency access easement, scenic easement or public utility easement. All dedications in fee and grants of easement shall be free of liens and encumbrances except for those which the City, in its discretion, determines would not conflict with the intended ownership and use.

The property dedicated shall also be free of environmental contamination. The City Engineer may require a Level 1 environmental assessment (records and superficial site review), and, when problems are indicated, a Level 2 environmental assessment (initial soil and groundwater sampling and analysis) before the final map or parcel map is approved. If the environmental assessment provided under Section 12.20.060 shows an unacceptable level of hazardous or toxic contamination on property proposed for dedication, the City

may require the subdivider to clean up the property or to revise the project and to dedicate an alternate site.

The City may elect to accept an irrevocable offer of dedication in lieu of dedication of fee title.

12.32.050 - Public facilities dedication requirements.

As a condition of approval of a tentative map, the subdivider shall dedicate land, pay a fee in lieu thereof, or both, for public facilities when authorized by state law and the City's general plan or applicable specific plans.
