§ 9.08

This chapter 9.08 of the Tracy Municipal Code may be referred to as the "City Electrical Code," and is adopted pursuant to Government Code section 50022.2. For purpose of clarity, the term "Code," when

used alone, shall refer to the Tracy Municipal Code.

The purpose of this chapter is to provide minimum standards to safeguard life or limb, health, property, and public welfare from hazards arising from the use of electricity for light, heat, power, radio, signaling, and for any other purpose. The purpose of this chapter includes: regulating the design, quality of materials, installation, and maintenance of electrical wiring, appliances, devices, or equipment, or any alteration thereof, or additions thereto, in the City; providing for the issuance of permits and collection of fees therefor; and providing for penalties for the violation thereof. The purpose of this chapter is not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefitted by the terms of this chapter.

9.08.030 - Adoption by reference of the California Electrical Code.

The City hereby adopts by reference the code entitled "2022 California Electrical Code," copyrighted by the National Fire Protection Association and approved by the California Building Standards Commission (hereinafter "California Electrical Code"), as amended by this chapter. The California Electrical Code is on file with the City Clerk, and is available for inspection and copying in accordance with Government Code section 50022.6.

Violations of this chapter shall be enforced by the City in accordance with Tracy Municipal Code section 9.02.040.

The City hereby makes the following local amendments to the California Electrical Code:

SECTION 250.52(A)(5) AND 250.52(A)(7)

Section 250.52(A)(5) and 250.52(A)(7) is amended to read as follows:

Section 250.52(A)(5) Rod and Pipe Electrodes. Rod and pipe electrodes shall be not less than 2.44 m (8 ft) in length and shall consist of the following materials.

(a)

Grounding electrodes of pipe or conduit shall not be smaller than metric designator 21 (trade size ¾) and any piping subject to undue corrosive action, shall be listed for corrosive soils or protected in a manner suitable for the purpose and is subject to the approval of the Building Official.

(b)

Rod-type grounding electrodes of stainless steel and copper coated steel shall be at least 15.87 mm (5/8inch) in diameter, unless listed for corrosive soils, unless listed.

Section 250.52(A)(7) Plate Electrodes. Each plate electrode shall expose not less than 0.186 m[2 ] (2 ft[2 ] ) of surface to exterior soil. Electrodes of electrically conductive coated iron or steel plates, shall be at least 6.4 mm (1/4 inch) in thickness and listed for corrosive soils. Electrodes of bare ferrous plates shall not be permitted. Solid, uncoated electrodes of non-ferrous metal shall be at least 1.5mm (0.06 in) in thickness.

9.08.060 - Administrative provisions to the California Electrical Code.

Administrative provisions to the California Electrical Code shall be enforced by the City in accordance with Division II requirements found in sections 101—116 of the California Building Code or sections R101— R114 of the California Residential Code, whichever applies.

9.08.070 - Corrosive Soils.

The City of Tracy has extensive areas where corrosive soils are present and therefore any ferrous or galvanized conduit, piping, connections or equipment in contact with the ground shall be appropriately protected unless otherwise listed.

9.08.140 - Connections to installations.

(a)

City Building Official's approval required. No person shall connect a source of electrical energy, or supply electric service, to any electrical equipment for the installation of which a permit is required without first obtaining the City Building Official's (or designee's) certificate of approval.

(b)

Unlawful reconnecting. No person shall connect a source of electrical energy, or supply electric service, to any electrical equipment which the City Building Official or designee has disconnected or ordered disconnected until he/she issues a certificate of approval authorizing its reconnection and use. The City Building Official or designee shall notify the serving utility of the order to discontinue use.

(c)

Power companies to notify City Building Official.

(1)

Notice. Whenever in, on or about any building any person engaged in the distribution or sale of electrical energy shall set, reset, install or reinstall or meter for the measurement of electrical energy, or connect or reconnect to, or supply or service any installation of electrical equipment, or change the nominal voltage of supply or service to any installation of electrical equipment, or shall change any such supply or service from two-wire to three-wire or vice versa, or from single-phase to polyphase or vice versa, or from direct current to alternating current or vice versa, that person shall within two (2) days thereafter, exclusive of Sundays and holidays, give written notice thereof to the City Building Official specifying the location and address of the installation affected.

(2)

Thirty (30) day exception. This notice need not be given for work expressly approved by the City Building Official or designee within thirty (30) days after inspection approval.

(d)

Authorization required. No person engaged in the distribution or sale of electrical energy shall connect a distribution system, including windpower generators, or any live supply or service conductor(s) therefrom, to any electrical equipment in, on or about any building or cause or allow any energizing of such connections, including windpower or emergency/stand by electrical generation until the City Building Official or designee inspects the electrical equipment and authorizes such connections.

(e)

Electrical permit required. An electrical permit shall be obtained from the City building inspection division to restore electrical service to any structure that has been without such service for ninety (90) days or more. The City Building Official or designee shall notify the servicing utility that the electrical service equipment and associated wiring has been inspected and approved before electrical service is reinstated.

(f)

Waiver. The City Building Official may, at his or her discretion, temporarily or permanently waive any or all requirements of this section by giving written notice of such waiver to all persons involved. He or she may likewise at anytime revoke such waiver by similar notice.

9.08.150 - Construction power and temporary release.

Required conditions.

(a)

Electrical construction power and lighting installations may be permitted during the period of construction, remodeling, maintenance, repair or demolition of buildings, structures or similar activities. Electrical construction power will be de-energized and discontinued when the permanent electrical system is approved by the City Building Official and ready to energize. Use of any permanent electrical equipment or distribution system for construction power utilization is not permitted. (See CEC Article 305, temporary wiring of construction sites.)

(b)

The City Building Official may allow the temporary use of electrical current through any electrical equipment, subject to the restrictions herein.

(c)

The City Building Official shall not allow such use when it is determined it will endanger life or property.

(d)

The City Building Official shall not allow such use for longer than reasonably necessary to fully comply with this chapter, and he or she may fix this time period when he or she grants the allowance.

(e)

The City Building Official may allow such use before completion of project if:

(1)

A permit has been obtained;

(2)

Panel cover trims to be in place on all service distribution panels;

(3)

Properly sized fuses or breakers are installed and in place only on needed circuits; and

(4)

Electrical installation has been approved by the City Building Official or designee.
