§ 19.40.010. Tentative notices of violation. ¶

Whenever the director or city engineer has information indicating that real property has been divided in violation of the Subdivision Map Act or this title, the director or city engineer shall file for record
with the county clerk/county recorder of the county of Orange a tentative notice of violation describing the real property in detail, naming the owners thereof, describing the violation and stating that an opportunity will be given to the owner to present evidence on the issue whether the property has been divided in violation of the Subdivision Map Act or this title. § 19.40.020. Receipt of evidence. ¶

Upon recordation of a tentative notice of violation, the director shall bring the matter before the subdivision committee, which shall schedule a meeting at which evidence as to why a final notice of violation should not be recorded may be presented. The owner of the land in question shall be given at least thirty days written notice of said meeting, unless the owner requests an earlier determination.

§ 19.40.030. Subdivision committee determination. ¶

A. If the subdivision committee determines that there has been no violation, the director shall file for record a release of the tentative notice of violation with the county clerk/county Recorder of the county of Orange.
B. If the subdivision committee determines that there has been a violation, or if within sixty days of receipt of such copy, the owner of such real property fails to inform the director of his/her/their objection to recording the notice of violation, the director shall file a final notice of violation with the county clerk/county recorder of the county of Orange.

§ 19.40.040. Release by certificate of compliance. ¶
