Chapter 14.04 — ANNUAL LIMIT—RURAL LAND DIVISIONS

14.04.010. Purpose.

The Board of Supervisors finds, pursuant to SCCC § 17.01.010 through § 17.01.040, that it is necessary and appropriate to establish a limit on the number of new residential parcels that may be created by land divisions each year in rural portions of the County. (Ord. 2674, 1979)

14.04.020. Definitions.

"Rural land division" means any subdivision or minor land division, as defined by SCCC § 14.01.105-S, which would potentially permit the construction of new housing units for sale or rental in the portions of Santa Cruz County outside the adopted urban services line (as provided by SCCC § 17.02.020).

Annual limitation on new residential parcels that may be created by rural land division.

The Board of Supervisors finds that a reasonable limit to the number of new residential parcels created each year by rural land division shall not exceed 35 percent of the number of residential building permits allocated during that year to the rural area. As an example, during 1979 the County has established that 370 residential building permits are to be allocated to the rural area; therefore 35 percent of that amount, or 130 parcels, may be created by rural land division in 1979. New residential parcels resulting from rural land divisions do not necessarily receive building permit allocations in the year in which the parcels are created. (Ord. 2674, 1979)

14.04.040. Implementation.

The Planning Department is hereby authorized and directed to develop such administrative rules and procedures as are necessary to give effect to the terms of this chapter, to be approved by the Board of Supervisors prior to final implementation or adoption. Such regulations shall become effective when approved by the Board of Supervisors and may be amended from time to time with the approval of the Board of Supervisors. (Ord. 2674, 1979)

14.04.050. Exceptions.

Rural land division applications submitted prior to January 16, 1979, or rural land divisions, whenever submitted, which are filed pursuant to a planned unit development use permit approved prior to January 16, 1979, shall be exempt from the provisions of this chapter. (Ord. 2674, 1979)
