§ 15.56.050. Violations.

  • A. Existence of a Substandard Dwelling. All dwellings, or portions thereof, shall be maintained, repaired or reconstructed in accordance with the housing code. Any dwelling, or portion thereof, which has become a substandard dwelling as defined herein, is declared to be a nuisance and a misdemeanor and shall be abated through correction, repair, reconstruction or demolition in accordance with applicable provisions of this article.

  • B. Rent or Lease of Substandard Dwelling. It is unlawful and a misdemeanor for the owner(s) or parties in interest of any dwelling, or portion thereof, that is a substandard dwelling to rent or lease, or to offer for rent or lease the substandard dwelling, or any portion thereof.

  • C. Dangerous Building. All buildings or portions thereof which are determined after inspection by the jurisdiction to be dangerous as defined by this ordinance are hereby declared to be public nuisances and shall be abated by repair, rehabilitation, demolition or removal in accordance with the provisions of this article.

  • D. Rent or Lease of Dangerous Building. It is unlawful and a misdemeanor for the owner(s) or parties in interest of any dangerous building or portion thereof to rent or lease or to offer for rent or lease the dangerous building or portion thereof.

  • E. Failure to Obey Notice and Order. It is unlawful and a misdemeanor for any owner to fail or refuse to comply with the terms and provisions stated in any notice and order issued under this article.

§ 15.56.060. Penalties and costs of enforcement.

  • A. Fines and Imprisonment. The county may seek, in addition to all other remedies available at law, criminal sanctions, contempt and other penalties provided for under Division 13, Housing, Part 1.5 of the Health and Safety Code (commencing at Section 17995).

  • B. Separate Offense for Each Day of Violation/Continuing Violation. Each person violating this article shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this article or a failure to comply with any regulation adopted pursuant to Section 15.56.080 or 15.56.290 or the provisions of Article 17.62 of Chapter 17 of this code is committed, continued, or permitted by any such person. Any violation which persists for more than one day is deemed a continuing violation for the purpose of this article.

  • C. Payment of Costs of Enforcement/Collection. In addition to any penalty, sanction, fine or imprisonment, each person who violates the provisions of this article, or who is convicted of any violation of any provision of this article, or who fails to comply with any regulation adopted pursuant to Section 15.56.080 or 15.56.290 or the provisions of Article 17.62 of Chapter 17 of this code, shall be required to pay any and all expenses of enforcement including those costs, necessary to bring the building, dwelling unit and/or dwelling, or portion thereof into compliance with this article and any regulation adopted pursuant to Section 15.56.080 or the provisions of Article 17.62 of Chapter 17 of this code. In addition to all remedies herein contained, the county may pursue all reasonable and legal means in
