§ 22.12.010 GENERAL DEFINITIONS.

When not inconsistent with the context, words used in the present tense include the future; words in the singular number include the plural, and the plural, the singular; words in any gender include the others; the word “shall” is mandatory; and the word may is permissive. Whenever any words or phrases used are not defined herein, but are defined in the Map Act or other state laws, such definitions are hereby incorporated by reference. § 22.12.015 BY RIGHT PROJECT.

A BY RIGHT PROJECT is one that is subject to ministerial review under California statutes, including, but not limited to, projects described as "use by right" in Cal. Gov’t Code § 65583.2 (i.e. that are 20% affordable on up-zoned sites, 20% affordable on prior Housing Element Sites Inventory sites), or SB 35 projects. (Ord. 4828, passed 2-26-24)

§ 22.12.020 CERTIFICATE OF COMPLIANCE.

CERTIFICATE OF COMPLIANCE means a document recorded by the County Recorder which identifies, by legal description, certain real property and states that the division thereof complies with applicable provisions of this title and the Map Act.

§ 22.12.030 COLLECTOR STREET.

COLLECTOR STREET means a street lower in classification and physical size than the arterials, that performs an equally important function in collecting neighborhood traffic from local streets and trans-ferring it to larger arterial streets or to the more local activity areas such as schools, shopping centers and employment centers. § 22.12.040 CONDOMINIUM.

CONDOMINIUM shall mean an estate in real property consisting of an undivided interest in common in a parcel of real property together with a separate interest in space in a residential, industrial or commercial building; such as, an apartment, office or store. In addition, a condominium may include a separate interest in other portions of such real property. Furthermore, condominium projects shall not be approved with fewer than four units, or six units for residential condominium projects, unless approval of a condominium project with fewer units is required by law. Such estate may, with respect to the duration of its enjoyment, be either:

  • (1) An estate of inheritance or perpetual estate.

  • (2) An estate for life, or

  • (3) An estate for years, such as a leasehold or subleasehold.

§ 22.12.042 CONDOMINIUM CONVERSION.

CONDOMINIUM CONVERSION shall mean the conversion of existing developed real property into a condominium, a community apartment project, or a stock cooperative.

§ 22.12.044 CONDOMINIUM COMMON AREA.

CONDOMINIUM COMMON AREA shall mean the entire condominium project area, excepting all units or areas thereon granted or reserved to individual ownership.

§ 22.12.046 CONDOMINIUM UNIT.

§ 22.12.050 DEDICATED STREET.

(A) DEDICATED STREET shall mean a public thoroughfare or right-of-way dedicated or deeded to the city for road purposes, and formally accepted as such by the city or condemned for use as such, other than an alley which affords the principal means of access to abutting property, including avenues, places, ways, drives, lanes, boulevards, highways, roads and any other thoroughfares except as excluded in this paragraph.

(B) Nothing herein shall preclude or stop the city from claiming a dedication by public use, but no dedication by public use may be asserted against the city if the city does not elect to accept or treat the street or road as dedicated. ('86 Code, § 22.12.050) (Ord. 4120, passed - - )

§ 22.12.060 DEVELOPMENT REVIEW COMMITTEE.

DEVELOPMENT REVIEW COMMITTEES shall mean a committee which consists of representatives of the following city departments: Community Development, Public Works, Police and Fire.

§ 22.12.070 FINAL MAP.

FINAL MAP shall mean a map showing a subdivision for which a tentative and final map is required by the Map Act or this title, prepared in accordance with the provisions of this title and the Map Act, designed to be recorded in the office of the County Recorder.

§ 22.12.080 GENERAL PLAN.

GENERAL PLAN shall mean the General Plan of the city, adopted in November, 1986, and any subsequent amendments thereto.

§ 22.12.090 LOCAL STREET.

§ 22.12.100 LOT.

§ 22.12.110 LOT LINE ADJUSTMENT.

LOT LINE ADJUSTMENT shall mean a minor or major shift or rotation of an existing lot line or other adjustments where a greater number of parcels than originally existed is not created.

§ 22.12.120 MAJOR ARTERIAL.

MAJOR ARTERIAL shall mean streets and highways designed to move large volumes of traffic between freeway systems and between the freeway and local areas of traffic generation. ('86 Code, § 22.12.120) (Ord. 4120, passed - - )

§ 22.12.130 MERGER.

MERGER shall mean the joining of two or more contiguous parcels of land under one ownership into one parcel, pursuant to Cal. Gov't Code Chapter 3, Article 1.5.

OWNER shall mean the individual, firm, association, syndicate, partnership, or corporation holding legal title to an interest in real property.

§ 22.12.150 PARCEL MAP.

PARCEL MAP shall mean a record map showing a division of land as required by Cal. Gov't Code § 66426(a)-(d), prepared in accordance with the provisions of this title and the Map Act. ('86 Code, § 22.12.150) (Ord. 4120, passed - - )

§ 22.12.160 PRIVATE STREET.

PRIVATE STREET shall mean a parcel of land not dedicated as a public street held by a private owner or over which a private easement for road purposes has been granted to the owners of property receiving access therefrom,

and the instrument creating the easement has been duly recorded or filed in the office of the Recorder of Los Angeles County.

§ 22.12.170 PRIVATE WAY.

PRIVATE WAY shall mean a road held by a private owner or a private road easement, recorded as such with the Recorder of Los Angeles County (satis-factory proof of which is filed with the city), the easement to serve as the principal means of access to not more than two lots, parcels of building sites.

§ 22.12.180 REMAINDER.

REMAINDER shall mean that portion of an existing parcel, or parcels of land which is not included as part of the subdivided land, pursuant to Cal. Gov't Code § 66424.6.

§ 22.12.190 SECONDARY ARTERIAL.

SECONDARY ARTERIAL shall mean a street to distribute traffic from the major arterials to the business districts and other centers of community activity, and also to the collector streets. ('86 Code, § 22.12.190) (Ord. 4120, passed - - )

§ 22.12.200 SPECIFIC PLAN.

SPECIFIC PLAN shall mean a detailed and comprehensive land use and development plan for a defined area within the city, adopted pursuant to Cal. Gov't Code §§ 65450 through 65456. A specific plan must be consistent with the General Plan and must contain regulations for the uses of land, including the conservation of open space, along with development standards and an implementation program to provide for all infrastructure and public services needed to support the land uses described in the plan.

§ 22.12.210 SUBDIVISION IMPROVEMENT STANDARDS.

SUBDIVISION IMPROVEMENT STANDARDS shall mean standard details, standard specifications, and other standards approved by the City Engineer that shall govern the improvements to be constructed pursuant to this title and the Map Act.

§ 22.12.220 VESTING MAP.

VESTING MAP shall mean a special form of a tentative map, filed pursuant to Cal. Gov't Code Chapter 4.5, which confers certain vested rights, for a specified period of time, to proceed with develop-ment in substantial compliance with the ordinances, policies and standards in effect at the time the vesting map is approved or conditionally approved. § 22.12.230 ZONING ORDINANCE.
