If the owner does not repair
  • The town engineer has the work done, and the owner must repay the town's necessary costs.
    Applies: When the owner refuses or neglects to make the required repair, reconstruction or improvement.

    If any owner refuses or neglects to make such repair, reconstruction or improvement when required and directed in conformity with the provisions of this chapter, the town engineer shall cause such repair, reconstruction or improvement to be made, and any and all costs necessarily expended by the town in making such repair, reconstruction or improvement shall be reimbursed to the town as described below in section 24-10.
Liability for injuries
  • The owner is directly liable for injury or property damage and must indemnify, defend and hold the town harmless.
    Applies: When the owner's failure to keep the sidewalk area safe causes injury or property damage.

    If any person suffers personal injury or damage to property, as a result of the failure of any owner to maintain any Sidewalk Area in a safe and nondangerous condition as required by section 24-02, the owner shall be directly liable to such person for the resulting injury or damages.
Deadline to repair
  • Start the repair within 2 weeks after notice is delivered, then finish it without interruption.
    Applies: After written notice from the town engineer.

    Within two weeks after such notice shall have been delivered to such owner, he or she shall cause to commence such repair, reconstruction or improvement as may have been determined by the town engineer and directed in the notice,
Who must repair it
  • The owner of property next to or fronting the sidewalk, at the owner's cost, even for street tree damage.

    The owner of real property adjacent to or fronting on any portion of a Sidewalk Area shall repair and maintain such Sidewalk Area in a safe and nondangerous condition at the owner's cost and expense.
