If the owner does not repair
  • The Director may repair the sidewalk; the cost goes through the city's notice, hearing, assessment and collection steps.
    Applies: If the repair is not started and finished with due diligence as the notice requires.

    If the repair is not commenced and prosecuted to completion with due diligence, as required by the notice, the Director may forthwith repair the sidewalk.
City help
  • On written request, the Director may repair more of the sidewalk in front; that cost joins assessed repair costs.

    The cost of repair work done by request pursuant to this Section shall be a part of the cost of repairs for which, pursuant to this Chapter, subsequent notices are given, hearings are held and assessment and collection procedures are conducted.
Liability for injuries
  • The owner or occupant is liable for injury or damage caused by failing to keep the sidewalk non-dangerous.

    If, as a result of the failure of any property owner or person in possession of such property to maintain the sidewalk area in a non-dangerous condition as required by Section 12.30.010, any person suffers injury or damage to person or property, the owner or occupier shall be liable to such person for the resulting damages or injury.

    The owners of lots or portions of lots adjacent to or fronting on any portion of a sidewalk area between the property line of the lots and the street line, including parking strips, sidewalks, curbs and gutters, and persons in possession of such lots by virtue of any permit or right, shall repair and maintain such sidewalk areas and pay the costs and expenses therefor.
