Program Scope and Objectives

Purpose: This IRM lists instructions on the EDS Data Transcription System (DTS) to EP specialists, reviewers, managers and other authorized EDS users to allow them to manually establish DL applications on EDS.

Program Goals: The goal of EP Determinations is to ensure that plans are in compliance with the tax laws by reviewing applications for Determination Letters (DL) and opinion letters, and to protect the public interest by applying the tax law with integrity and fairness to all.

Background

The Tax Exempt Determination System (TEDS) is the primary system Employee Plans (EP) uses to process Determination Letter (DL) applications. Generally, EP will establish and work DL applications in TEDS but create the final DL in the EP/EO Determination System (EDS). However, in rare circumstances, an application will not be established in TEDS at all and will be established and processed only in EDS.

Do not establish an application on EDS without managerial approval.

EDS is divided into six sub-sections.

Data Transcription System (DTS) generates EP Applications and Transmittal sheets.

EDS is a menu-driven system. You can choose functions from a list of available options. When you select a valid option, it will display an input screen or another submenu. When you complete an option, the higher level menu is displayed so you may select another option or exit EDS.

Authority

Delegation Order 7-1, IRM 1.2.2.8.1, states the Director, Employee Plans has authority to issue favorable DLs on the qualified status of:

Pension, profit-sharing, stock bonus, annuity, and employee stock ownership plans under IRC 401, IRC 403(a), IRC 409, IRC 4975(e)(7).

The status for exemption of any related trusts or custodial accounts under IRC 501(a).

Roles and Responsibilities

The mission of Employee Plans is to provide EP’s customers top quality service by helping them understand and comply with applicable tax laws and to protect the public interest by applying the tax laws with integrity and fairness to all.

The Director, EP, reports to the Deputy Commissioner, TE/GE, and is responsible for planning, managing, directing and executing nationwide EP activities.

EP responsibilities include:

Employee plans (including the qualification of pension, annuity, profit-sharing, and stock bonus plans, simplified employee pensions, saving incentive match plans for employees, and tax-sheltered annuities) and related trusts.

Tax treatment of participants and their beneficiaries and deductions for employer contributions.

Procedural and administrative provisions with respect to such plans.

The Director, EP R&A, reports to the Director, EP, and is responsible for three types of services for retirement plans - voluntary compliance, determination letters, and technical guidance.

Responsibilities of the EP R&A staff include:

Processing determination letter requests from employers regarding the qualified status of their pension, annuity, profit sharing and stock bonus plans.

Issuing opinion and advisory letters to specific requestors regarding preapproved pension, annuity, and profit-sharing plans, including individual retirement accounts, simplified employee pensions and savings incentive match plans for employees, and tax sheltered annuities.

Developing and operating voluntary correction programs, such as the Employee Plans Compliance Resolution System (EPCRS) program and issuing compliance statements or entering into closing agreements under these programs.

Processing requests for changes in funding method and making other actuarial determinations and interpretations.

Coordinating with Chief Counsel on requests for funding waivers.

Developing and maintaining responsibility for actuarial publications and other standards for the valuation of transfers of future interests for income, estate and gift tax purposes.

Coordinating with TE/GE Division Counsel, Associate Chief Counsel and the DOJ on litigation issues and declaratory judgement cases under the Internal Revenue code. (IRC 7476).

Program Management and Review

Program reports:

The EP Determinations program uses Business Objects to view, create, and modify inventory and employee records. Business Objects uses tools to provide a built-in interface to query and analyze data and to build reports.

Monthly reports detailing the current inventory of cases by area and their status are produced and provided to the Director, EP R&A, Area Managers, and frontline managers.

Ad-hoc reports are produced as requested by determinations personnel with appropriate permission.

Each quarter, EP Determinations Quality Assurance issues reports to summarize the results of their TEQMS reviews. See IRM 7.11.3, Tax Exempt Quality Measurement System (TEQMS).

Program effectiveness:

EP Determinations monitors business unit progress toward completing and closing cases in inventory. They provide status and progress reports to IRS leadership on a regular, recurring basis. Effectiveness is measured by analysis of compliance trends and results.

Program Controls

The IRS receives EP determination letter applications and user fees from taxpayers on Pay.gov.

The user fee information is then transferred to LINUS to ensure it is properly recorded.

The application information from Pay.gov is transferred to Tax Exempt Determination System (TEDS) and EP/EO Determination System (EDS) which are the systems that EP Determinations uses to control their inventory.

TEDS contains roles and permissions to ensure proper separation of duties. See IRM 7.15.4.

The EP Determinations Area Managers coordinate the assignment of inventory.

In order to ensure a consistent level of managerial engagement in the process of making key strategic decisions during a determination letter review, the specialist submits requests for approval by their manager through TEDS.

The manager approves or rejects any request through TEDS.

EP Determinations QA reviewers perform reviews on mandatory review cases and for cases selected for the Tax Exempt Quality Measurement System (TEQMS) to ensure that specialists are conducting their determination letter reviews per technical, procedural and administrative requirements. See IRM 7.11.3 and IRM 7.11.9 for more information.

Application Forms

The main input documents for EDS and TEDS are the EP application forms.

Establishing an Application on TEDS

In most circumstances, the IRS establishes cases using these procedures:

The Tax Exempt and Government Entities (TE/GE) Deposit Unit processes the user fee on Letter Information Network User Fee System (LINUS) using the procedures in IRM 3.45.1.10.6.2, TE/GE Processing, Processing Employee Plan and Exempt Organization Determination Applications and User Fees.

The application is then established on TEDS using the procedures in IRM 3.45.1.11. The user fee information is then uploaded from LINUS to TEDS.

All of the information from TEDS is then uploaded to EDS.

Establishing an Application on EDS

If necessary, and with managerial approval, you can establish an application in EDS. The following is a walk through the process to establish applications in EDS. The exhibits in this IRM contain screenshots and more detailed instructions.

After logging into EDS, the system displays the EDS main menu screen. See Exhibit 7.14.2-1.

Select Option 2 to enter into DTS. See Exhibit 7.14.2-2.

If application data is found in the hold (scanned) file, the data will be displayed in each of the appropriate fields.

Verify the data for accuracy; fill in any required blank fields.

If no application data is found in the hold file, a blank screen will be displayed and you must enter the data in each input field.

Verify/enter response to the screen prompts in the input fields.

Find the answers to the questions on the application form.

Use the arrow and/or tab keys to skip over fields.

Use the same keys to position the cursor in the next input field when an input field is not completely filled.

Press F1 after you verified or entered all the required fields.

EDS performs edits and consistency checks to ensure that the data verified/entered is correct.

If there is an input error, the screen will display the error message and the cursor will be on the field in error. Once you have corrected all of the data, press F1.

If there are no input errors, press F1.

Complete the Power of Attorney (POA) screen after you have entered all of the application data. Press F1 to accept the POA data. The bottom left of the screen will display a message "Case Complete" and display the case number. Record this case number on the EP Determinations Input Sheet located on the front of the case file. If a duplicate record is found, the Duplicate Establishment screen will be displayed. If there is no duplicate record, the Print Format/Selection Screen will be displayed.

Reprint Transmittal Sheet

To reprint a transmittal sheet, the case must be established and assigned an EDS Case Number. If the case number is unknown, use the Query/Update Master File option of the Inventory Control Subsystem (ICS) to obtain the case number. See IRM 7.14.5, Employee Plans EDS User Manual, Inventory Control Subsystem (ICS).

The Reprint Transmittal Sheet screen will allow you to enter up to 20 case numbers per screen. After you have entered all case numbers, press F5 to select a printer. The program will display a blank screen continuously to print a maximum of 20 transmittal sheets per blank screen until you press F10 to exit.

The Incomplete Case Number option was primarily used prior to determination work centralizing in the EP Determination Centralized Site in Cincinnati (EP-DCSC).

When you enter a case number, the system checks to see whether the case number exists. (Note: Incomplete Letter records are removed from the system after 180 days.)

If the DLN exists, the data previously entered on LINUS for the Employer Identification Number (EIN), Name, Address, and User Fee is displayed on the EP Initial Screen. See Exhibit 7.14.2-3.

If the DLN does not exist, a blank EP Initial Screen is displayed. See Exhibit 7.14.2-3.

TEDS is the primary system for processing DL applications. Most applications will be established on TEDS and only the final DL will be created on EDS. Do not establish an application using these procedures without managerial approval.
