10.20.010. - Purpose.¶
The purpose of this Chapter is to regulate the emplacement and use of travel trailers and motor homes as temporary places of human habitation within the unincorporated areas of the County of Yuba which are zoned AE, A/RR, RRE or any other zone as permitted by the Yuba County Zoning Ordinances as from time to time amended, during the construction of a permanent residence, or as otherwise allowed herein for a limited term.

10.20.020. - Definitions.¶
The following terms used in this Chapter shall be defined as follows:
Building Official means the Director of the Building Department within the Community Development and Services Agency.
Camping trailer means a vehicular portable unit mounted on wheels and constructed with collapsible partial side walls which fold for towing by another vehicle and unfold at the campsite to provide temporary living quarters for recreational, camping, or travel use.
Motor home means a vehicular unit built on or permanently attached to a self-propelled motor vehicle chassis, chassis cab or van, which becomes an integral part of the completed vehicle, primarily designed to provide temporary living quarters for recreational, camping or travel use.
Slide-in camper or truck camper means a portable unit, consisting of a roof, floor and sides, designed to be loaded onto and unloaded from the bed of a pick-up truck, constructed to provide temporary living quarters for recreational, travel or camping use.
Travel trailer means a vehicular portable unit, mounted on wheels, of such a size or weight as not to require special highway movement permits when drawn by a motorized vehicle; primarily designed and constructed to provide camping, or travel use.

10.20.030. - Permit; required.¶
No person shall emplace or occupy as a place of human habitation any travel trailer or motor home regulated by this Chapter unless and until a travel trailer or motor home Emplacement Permit is issued by the Building Official, and only during the term of such permit.

10.20.040. - Permit; application.¶
A travel trailer or motor home emplacement permit shall be issued by the Building Official upon application and payment of the fee established in Section 13.20.200 and upon the finding and determination of the Building Official that the emplacement substantially complies with the sanitation standards specified herein including all applicable State statutes and County ordinances and posting of a bond with the County of Yuba Planning Department in the amount of $1,000.00. The bond may be redeemed from the County of Yuba Planning Department at such time that the travel or motor home is no longer being used as a temporary place of human habitation demonstrated by finalization of the travel trailer or motor home Emplacement Permit through the County of Yuba Building Department.

10.20.050. - Permit; issuance standards.¶
To qualify for a travel trailer or motor home Emplacement Permit:
(1) The proposed location for emplacement of a travel trailer or motor home governed and regulated by this Chapter must be in the County of Yuba zoned AE, A/RR, RRE or any other zone as permitted by the Yuba County Zoning Ordinances as from time to time amended, and must comply with all such zoning laws of the County;
(2) A building permit for a residence must have been issued; and
(3) There must be approved sanitation, running water, cooking and heating facilities.

10.20.060. - Permit; term.¶
A travel trailer or motor home Emplacement Permit may be issued for a term of 18 months, to run concurrently with the term of the permanent resident Building Permit required in Section 10.20.050 of this Chapter.

10.20.070. - Permit; conditions.¶
The issuance of the travel trailer or motor home Emplacement Permit may be subject to such conditions as are determined necessary by the Building Official to protect the public health, safety and welfare. Such conditions shall be clearly shown on the permit.

10.20.080. - Permit; revocation; modification; suspension.¶
Any permit issued under the terms of this Chapter or any extension thereof may be revoked, modified, or suspended by the Building Official for violation of the provisions of this Chapter or of any terms or conditions attached to the permit or extension. Notice of such action shall be given by the Building Official within ten days thereof to the mailing address of the permittee as shown on the application for permit, by personal service, or by posting on the travel trailer or motor home.

10.20.090. - Permit; waiver of requirement.¶
Upon a showing of good cause, and in the discretion of the Building Official, the provisions of Sections 10.20.050 and 10.20.060 of this Chapter may be waived by the Building Official. When such waiver is made the Building Official shall include in the file his written reasons therefor.

10.20.100. - Limitations on Chapter.¶
This Chapter shall not be construed to allow the emplacement regulated by this Chapter by truck or slide-in campers or by camping trailers. This Chapter shall also not be construed to have any application to mobile homes, the emplacement of which is regulated by Chapter 10.25 of the Yuba County Ordinance Code. This Chapter shall further not be construed to prohibit or regulate the emplacement of travel trailers or motor homes for short periods of time in duly established tourist camps, trailer parks, resorts, hunting camps or the like.

10.20.110. - Penalty.¶
Any person who uses, occupies, or maintains any travel trailer or motor home in violation of any provision of this Chapter is guilty of a misdemeanor, and upon conviction thereof is punishable by imprisonment in the County Jail for a term not exceeding six months or a fine not exceeding $1,000.00 or both such fine and imprisonment. Each separate day or a portion thereof is a separate offense.

10.20.120. - Severability.¶
If any section, subsection, sentence, clause, phrase, provision or portion of this Chapter, or the application thereof to any person or circumstances, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions or provisions of this Chapter or their applicability to distinguishable situations or circumstances. In enacting this Chapter, it is the desire of the Board of Supervisors to validly regulate to the full measure of its legal authority in the public interest, and to that end, the Board of Supervisors declares that it would have adopted this Chapter and each section, subsection, sentence, clause, phrase, provision, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions thereof might be declared invalid or unconstitutional in whole or in part, as applied to any particular situation or circumstances, and to this end the provisions of this Chapter are intended to be severable.
