Sec. 96.01 - Purpose of regulations.

(A) Public trails are valuable recreational facilities which are recognized as being a part of the rural character of the Town and, as such, are developed and maintained primarily for use by residents of the Town and their guests.

(B) In order to protect the public health, safety, and welfare of the residents and property owners, it is essential to maintain public trails and at the same time protect the privacy and safety of private property.

(C) This chapter is specifically designed to implement the Town General Plan, Circulation and Scenic Highways Elements, Trails (General Plan Sections 2427 through 2434).

Sec. 96.02 - Obstructions restricted.

(A) General. Obstructions to public trails shall be prohibited and shall not be installed, placed, or maintained on a public trail unless authorized by the Town. Obstructions shall consist of, but shall not be limited to, the following:

(1) Fences or gates installed in or across any public trail;

(2) Trees, bushes, shrubs, or other plantings, unless trimmed or maintained so as not to obstruct the safe and convenient use of the trail;

(3) Structures of any kind, including, but not limited to, sheds, irrigation systems, and wells;

(4) Corrals or pastures for livestock, all or a portion of which encroach into the public trail easement;

(5) Pens or runs for fowl or animals;

(6) Vehicle parking;

(7) Paving by the use of any impervious substance; and

(8) Movable objects, such as firewood, lumber, pipe, or loads of gravel, sand, or debris, which are upon or extend within the public trails easement.

(B) Fences and gates.

(1) Trails on public road rights-of-way or privates. No fence, gate, wall, planting, or other obstruction shall be installed, placed, or maintained on a public trail located within the right-of-way of any public street, road, or highway or any private road.

(2) Dedicated trail easements adjacent to and parallel to public road rights-of-way or private roads. Fences shall not be permitted along trail easement boundaries adjacent to public road rights-of-way or private roads. Fences shall be permitted along a trail easement boundary nearest to the interior portion of the private property on which such trail easement is located provided no part of such fence shall encroach into or upon the public trail easement.

(3) All other public trail easements. No gate shall be installed, placed, or maintained within a public trail easement, except that the Town may permit a gate to be installed at the intersection of a public trail easement and a public or private road. No fence, planting, or other obstruction shall be installed, placed, or maintained within a public trail easement without the permission of the Town.

Sec. 96.03 - Supplemental rules and regulations; violations.

The Council, from time to time, may adopt by resolution rules and regulations for the purpose of controlling the use of trails and implementing this chapter. Each violation of such rules and regulations duly adopted shall be deemed to be an infraction and subject to the penalties set forth in Section 10.99 of this Code.

Sec. 96.04 - Prohibited uses.

Any use of a public trail other than for the use or purpose for which the public trail was dedicated shall be prohibited.

Sec. 96.05 - Violations.

It shall be unlawful for any person to violate any provision or to fail to comply with any of the requirements of this chapter. Each violation of this chapter shall be a misdemeanor, except a violation of Section 96.03 which shall be an infraction, and subject to the penalties set forth in Section 10.99 of this Code.
