Sec. 95.01 - Encroachment permit required.

It shall be unlawful for any person, firm, or corporation, public or private, to construct or install within the public rights-of-way of the Town any side road or private driveway, or any culvert or other drainage facility, or any other improvement or structure unless and until an encroachment permit has been obtained from the Town Engineer.

Sec. 95.02 - Applications.

(A) Applications for the encroachment permits required by the provisions of this chapter shall be made to the Town Engineer and shall be accompanied by a fee in an amount fixed annually by resolution of the Council.

(B) Any application for an encroachment permit required by the provisions of this chapter which would establish more than one private driveway to serve any single lot or parcel shall be referred to the Planning Commission for review and recommendation. The Town Engineer shall thereafter act on the permit, taking into consideration the recommendations of the Planning Commission.

Sec. 95.03 - Establishment of grade lines.

After the issuance of the encroachment permit required by the provisions of this chapter, the Town Engineer shall establish for the permittee the location and grade lines for all improvements or facilities to be located in the public right-of-way and shall specify other conditions necessary to protect the public safety and property.

Sec. 95.04 - Standard plans and standard specifications.

All work and improvements installed in the public right-of-way shall conform with the standard plans and standard specifications of the Town and shall be installed to the satisfaction of the Town Engineer.

Sec. 95.05 - Appeals.

The Council may consider appeals from the provisions of this chapter, from the recommendations of the Planning Commission, and from the determinations of the Town Engineer. Such appeals shall be filed with the Town Clerk and shall set forth all of the pertinent factual material on which the appeal is based. The Council may make determinations of alternate methods, standards, or materials when, in its opinion, the strict compliance with the provisions of this chapter, the recommendations of the Planning Commission, or the decisions of the Town Engineer are unnecessary.
