Sec. 92.30 - Permit required.

No individual, corporation, partnership, or other legal entity shall conduct a bingo game without first obtaining a permit from the Town Manager to do so.

Sec. 92.31 - Application.

Any organization desiring to conduct a bingo game shall file an application for a permit with the Town Clerk. The issuing authority shall be the Town Manager. Such application shall be under penalty of perjury and shall contain the following information:

(A) The name of the organization and the names and addresses of all the officers of the organization and the signatures of at least two officers, including the presiding officer of the organization;

(B) The days and hours of the operation of bingo games;

(C) A copy of the certificate or letter from the Franchise Tax Board of the State evidencing exempt status under Cal. Rev. & Tax. Code § 23701 subsections (a), (b), (d), (e), (f), (g), and (l) if so exempt;

(D) If the applicant claims eligibility as a mobile home association or a senior citizens organization, a statement describing the membership and purpose of the organization should be submitted;

(E) The address of the premises where bingo games will be conducted;

(F) A statement of ownership or lease of the premises;

(G) The purposes for which such premises are used by the organization;

(H) A statement of consent for the Sheriff to inspect any bank account containing profits derived from bingo games;

(I) The name of each individual, corporation, partnership, or other legal entity which has a financial interest in the conduct of the bingo games;

(J) The name of the person responsible for the operation of bingo games;

(K) A statement that the profits derived shall be used for charitable purposes only; and

(L) Such further information as may be required by the Town Manager to effectuate the purposes of this chapter.

Sec. 92.32 - Investigation of applicants.

Upon the receipt of the completed application, the Town Manager shall refer the application to interested departments of the Town, including, but not limited to, the Town Attorney, Sheriff's Department, Fire Department, and Planning Department, for investigation as to whether or not all of the statements in the application are true, and whether or not the property of the applicant qualifies, and the extent to which it qualifies as property on which bingo games may lawfully be conducted as to fire, occupancy, and other applicable restrictions.

Sec. 92.33 - Suspension of operations; revocation of permit.

(A) If any bingo game is conducted in violation of this chapter, the Sheriff or his/her representative may stop any bingo game in progress and initiate proceedings in accordance with this section.

(B) If a permit has been issued and the Town Manager determines that the permit is revocable because of a violation of this chapter, he/she shall serve the permittee a notice of intent with the reason for the proposed revocation. The notice shall provide for revocation within seven days after the service of the notice, unless the permittee requests an informal hearing with the Town Manager.

(C) The Town Manager shall give at least five days' prior written notice of the time and place of the hearing. A written decision shall be issued within seven days following the decision.

Sec. 92.34 - Reserved.

Sec. 92.35 - Permit fees.

(A) The fee for a general permit and each renewal shall be set by resolution of the Town Council.

(B) The fee for a special permit shall be $25.00 payable at the time the application for such permit is made.

(C) If an application for a permit is denied, one-half of any permit fee paid shall be refunded to the organization.

Sec. 92.36 - Permit term; permit nontransferable.

(A) General permits shall be granted for one-year terms; each term shall be renewable annually. Written applications for the renewal of a general permit shall be made to the Town Manager more than 15 days prior to its expiration date.

(B) Special permits shall be granted only for a one-day term for each bingo game. Such special permits shall not be renewable.

(C) Permits granted under this chapter shall not be transferable, either as to the permittee or the location. Any attempt to transfer shall render the permit in question invalid.

Sec. 92.99 - Penalty.

(A) Any person who violates the provisions of Sections 92.10 through 92.15, 92.17 through 92.19, 92.30, 92.31, 92.35 or 92.36(C) shall be guilty of a misdemeanor.

(B) A violation of the provisions of Section 92.12 of this chapter shall be punishable by a fine not to exceed $10,000.00 which fine shall be deposited in the general fund of the Town.
