Sec. 92.10 - Authorized organizations.¶
Pursuant to Cal. Penal Code § 326.5, those organizations exempt from the payment of taxes by Cal. Rev. & Tax. Code § 23701(a), (b), (d), (e), (f), (g), and (l), as well as mobile home park associations and senior citizens organizations, are hereby allowed to conduct bingo games in the Town if such organizations have complied with this chapter.

Sec. 92.11 - Staffing and operation.¶
Bingo games shall be operated and staffed only by members of the authorized organization which organized them. Only the organization authorized to conduct a bingo game shall operate such game or participate in the promotion, supervision, or any other phase of such game.

Sec. 92.12 - Profits, wages and salaries unlawful.¶
No person shall receive or pay a profit, wage, or salary from any bingo game authorized by this chapter.

Sec. 92.13 - Location.¶
An authorized organization shall conduct a bingo game only on property owned or leased by it, and which property is used by such organization for an office or for the performance of the purposes for which the authorized organization is organized. Nothing in this section shall be construed to require that the property owned or leased by the authorized organization be used or leased exclusively by such authorized organization.

Sec. 92.14 - Open to the public; minors prohibited; physical presence required.¶
(A) All bingo games shall be open to the public, not just to members of the authorized organization.

(B) No minor shall be allowed to participate in any bingo game.

(C) No person shall be allowed to participate in a bingo game unless the person is physically present at the time and place in which the bingo game is being conducted.

Sec. 92.15 - Financial interests.¶
No individual, corporation, partnership, or other legal entity, except the organization authorized to conduct a bingo game, shall hold a financial interest in the conduct of such bingo game.

Sec. 92.16 - Funds and accounts.¶
With respect to organizations exempt from the payment of the bank and corporation tax by Cal. Rev. & Tax. Code § 23701d, all profits derived from bingo games shall be kept in a special fund or account and shall not be commingled with any other fund or account. Such profits shall be used only for charitable purposes. With respect to other organizations authorized to conduct bingo games pursuant to this chapter, all proceeds derived from bingo games shall be kept in a special fund or account and shall not be commingled with any other fund or account. Such proceeds shall be used only for charitable purposes, except as follows:
(A) Such proceeds may be used for prizes; and
(B) A portion of such proceeds, not to exceed ten percent of the proceeds after the deduction for prizes, or $500.00 per month, whichever is less, may be used for the rental of property and overhead and administrative expenses.

Sec. 92.17 - Total value of prizes.¶
The total value of prizes awarded during the conduct of any bingo game shall not exceed $250.00 in cash or kind, or both, for each separate game which is held.

Sec. 92.18 - Hours of operation.¶
All bingo games shall be conducted only during the hours from noon until midnight.

Sec. 92.19 - Records.¶
Each organization conducting a bingo game shall maintain detailed records of all profits, expenditures, prizes, and other expenses associated with the operation of bingo games. Such records shall be retained for such periods of time as required by state and federal laws but in no event for a period of less than three years for the purposes of this chapter. No organization required to keep records shall refuse to allow authorized representatives of the Town to examine such records at reasonable times and places.
