Sec. 51.030 - Permits and operation.¶
(A) Where a public sanitary sewer is not available, as defined in Section 51.015(C) of this chapter, the building sewer shall be connected to a private wastewater disposal system complying with the provisions of this subchapter.
(B) Before commencement of construction of a private wastewater disposal system, the owner shall first obtain a written permit from the Town, and from any other public agency having jurisdiction over such matters.
(C) (1)
The type, capacities, location, layout, operation and maintenance of a private wastewater disposal system shall comply with all applicable regulations promulgated by any government agency having jurisdiction with respect to the discharge of wastewater into a private wastewater disposal system.
(2) An initial inspection of the property in or upon which each individual sewage disposal system is to be placed shall be made by the Town to determine the feasibility of a rural sewage disposal system functioning properly. Percolation tests shall be made in the area of the proposed location of the site of the drainfield by the owner of the property, or the representative, under the direction and supervision of the Town. A permit shall not be issued if, in the opinion of the Town, the proposed disposal system will not function in a sanitary manner due to the lack of porosity of the ground or by reason of inadequate area available for the proposed disposal system.
(D) No septic tank, cesspool or other private wastewater treatment or disposal system shall be permitted to discharge effluent to any natural outlet to public sewer.
(E) The property owner shall operate and maintain the private wastewater disposal facilities in a sanitary manner at all times, at no expense to the Town.
(F) At such time as a public sewer becomes available to a property served by a private wastewater disposal system, and direct connection to the public sewer is made in the manner required by this Code, the private wastewater system shall be abandoned and filled in the manner directed by the Town.

Sec. 51.031 - County regulations incorporated.¶
The written departmental regulations promulgated by the County Health Officer pursuant to the county code to obtain compliance with the provisions of this subchapter and to clarify its relations with the laws of the state are hereby incorporated as they now exist, and as they may be amended from time to time by the county.
