Sec. 32.01 - Creation.

Pursuant to the provisions of Government Code § 65100, a Planning Commission, consisting of five members, is hereby created.

Sec. 32.02 - Appointments.

(A) The members of the Planning Commission shall be appointed by the Council by a majority vote of the full membership thereof. Appointments to the offices, the terms of which expire in a given year, shall be made by the Council at the first regular meeting on or after February 1 in such year.

(B) All appointments, including those to fill vacancies, shall be made from nominations filed in writing, no later than 15 days prior to selection, with the Town Clerk by any citizen on his/her own behalf, or by another citizen, stating the qualifications and reasons for the appointment of the nominee. The Council may make additional nominations and shall review all statements of qualification before selection and appointment.

(C) The Town Clerk shall circulate the statements of the qualifications of the nominees to all members of the Council prior to such appointments to office.

Sec. 32.03 - Terms of office.

Each term of office of a member of the Planning Commission shall be for a period of four years and until the qualification of the successor to the member whose term expires.

Sec. 32.04 - Residence.

No more than one member of the Planning Commission shall have his/her place of legal residence in, and be appointed from, each district of the Town; provided, however, the Council, by two-thirds vote of the full membership thereof, may appoint two or more members having their places of legal residence in the same district. If two or more members from the same district are so appointed, the Council shall designate which such members shall be appointed to which term or terms of office. If a member, during his/her term of office, removes his/her place of legal residence from one district to another, he/she may nevertheless complete the term of his/her office. If a member removes his/her place of legal residence from the Town, his/her office shall become vacant and shall be filled as for any other vacancy.

Sec. 32.05 - Vacancies; removal from office.

Vacancies occurring in the membership of the Planning Commission shall be filled by appointment for the unexpired portion of the term of each such office. Any appointee to the Planning Commission may be removed from office by not less than five members of the Council voting in favor of such removal.

Sec. 32.06 - Powers and duties.

The Planning Commission shall have the powers and duties set forth in Cal. Gov't Code and the general laws of the state and as set forth in this Code, which shall include, but not be limited to, the following:

(A) To prepare a general plan and development policy for the Town for recommendation to the Council;

(B) To recommend such ordinances and resolutions to the Council as are necessary to implement the general plan and development policy adopted by the Council;

(C) To participate in the administration of the laws and policies of the Town by conducting the necessary public hearings and acting upon applications for zoning amendments, conditional use permits, variances, subdivisions, and other functions as may be assigned by the Council;

(D) To recommend to the Council changes, when necessary, in the general plan, the development policy, and pertinent laws;

(E) To prepare and recommend to the Council such specific plans as it deems necessary to supplement the general plan; and

(F) To periodically review the capital improvement program of the Town.
