Sec. 31.01 - Office established; appointment.¶
(A) Pursuant to the authority granted by the provisions of Cal. Gov't Code §§ 36501 and 37209, the office of Town Finance Director is hereby created and established.

(B) The Council, by resolution, shall appoint the Town Finance Director.

Sec. 31.02 - Bond.¶
Before entering upon the duties of his/her office, the Town Finance Director shall be bonded to assure the faithful and honest performance of his/her duties as set forth in Section 31.01. The penal sum of the bond shall be in a reasonable amount as recommended by the Town Attorney and fixed by the Council by resolution. Any premium for such bond shall be a proper charge against the Town.

Sec. 31.03 - Powers and duties.¶
It shall be the duty of the Town Finance Director to act in all cases to promote, secure, and preserve the financial and property interests of the Town, and he/she shall have the following general powers and duties:
(A) To perform the duties imposed upon the Town Clerk by Cal. Gov't Code §§ 37200 through 37209 and 40802 through 40805;
(B) To exercise general supervision over all Town officers regarding the proper management of the fiscal concerns of their respective offices, prescribe the form of accounts and reports to be rendered to him/her, and ensure that budget appropriations are not exceeded;
(C) To examine and audit from time to time the accounts of all officers and departments;
(D) To ascertain that all officers and employees receiving money pay such money into the Town treasury as required and that all the necessary financial reports are made by the Town officers. The Finance Director shall report all delinquencies or defaults in payments or in reports to the Council;
(E) To demand and receive all moneys and fees owing to the Town whenever the means of collection of such moneys and fees is not otherwise prescribed by law;
(F) To prepare and audit a register of demands against the Town and certify the register of demands to the Council at each regular Council meeting;
(G) To keep all general accounts of the Town government and transmit, at least monthly, to the Council and all departments and officers current information of the classified unencumbered appropriation balances;
(H) To collect all licenses and fees in the manner authorized and required by law and issue all permits and licenses, except those which are required by law to be issued by a particular department or officer; and
(I) To perform such additional duties as are prescribed from time to time by the Council or state authority.

Sec. 31.04 - Town Clerk.¶
(A) The Town Clerk shall perform the duties prescribed by law, including the duties prescribed by Cal. Gov't Code § 40801 et seq., and any additional duties as prescribed by the Town Manager. The Town Clerk is appointed by the Town Manager and shall hold said office at the pleasure of the Town Manager.
(B) The financial, accounting, and other duties imposed upon the Town Clerk by Cal. Gov't Code §§ 37200 through 37209 and 40802 through 40805.5 are hereby transferred to the Town Finance Director in accordance with the provisions of Cal. Gov't Code §§ 37209 and 40805.5.

Sec. 31.05 - Designation of Town Manager as Town Finance Director.¶
Unless the Town Council has appointed the Town Finance Director under this subchapter, the Town Manager or his/her designee shall act and perform the duties of Town Finance Director.

Sec. 31.06 - Town Treasurer.¶
The Town Finance Director is designated as, and shall perform all the duties of the office of Treasurer under Cal. Gov't Code § 36501, and any other duties and responsibilities imposed on the office of Treasurer under state law.
