9-4-200 - Prohibition of Illegal Discharges.

a. The release of non-storm water discharges to the Town's storm drain system is prohibited.

b. The following discharges are exempt from the prohibition set forth in subsection (a) of this section:

  1. Any discharge in compliance with a National Pollution Discharge Elimination System (NPDES) permit issued to the discharger and administered by the State of California under the authority of the United States Environmental Protection Agency.

  2. Discharges from the following activities to the Town's storm drain system are permitted provided such discharges are not a significant source of pollutants and are conducted in accordance with the best management practices presented in the Town's "Final Non-Storm Water BMP Plan," dated December 2015, as may be amended from time to time:

(a) Diverted stream flows;

(b) Natural springs and rising groundwater;

(c) Uncontaminated groundwater infiltration into structures;

(d) Overflows/diversions from riparian habitats and wetlands where such flows are intentionally diverted into the storm drain system;

(e) Flows from firefighting training and equipment repair;

(f) Flows from firefighting;

(g) Fire hydrant testing, service and repair;

(h) Discharge from potable water sources;

(i) Utility vault dewatering;

(j) Gravity flow from foundation, footing, and crawl space and drains;

(k) Residential air conditioning condensate;

(l) Water from crawl space pumps;

(m) Potable water runoff from urban landscape irrigation (minor amounts);

(n) Recycled water runoff from urban landscape irrigation (minor amounts);

(o) Recycled water runoff from agricultural sites;

(p) Dechlorinated/debrominated swimming pool/spa discharges;

(q) Runoff from non-commercial car washing by residents or non-profit organizations;

(r) Pooled storm water from treatment BMPs that are intentionally discharged to the storm drain system as part of maintenance activities;

(s) Municipal water tank maintenance;

(t) Runoff from surface cleaning of sidewalks and other impermeable surfaces; and

(u) Runoff from surface cleaning of building exteriors, rooftops and walls.

c. Any discharge that would result in, or contribute to, a violation of any NPDES permit for storm water discharges within the Town is prohibited. Liability for any such discharge shall be the responsibility of the person(s) causing or responsible for the discharge.

d. No person shall deposit any hazardous materials or wastes, yard debris, refuse, or other discarded or abandoned objects or articles in or upon any component of the storm drain system or upon any public or private plot of land in the Town, so that the same may cause or contribute to pollution.

e. It is unlawful to establish, use, maintain, or continue unauthorized drainage connections to the Town's storm drain system, or any drainage connections that are or may be a source of prohibited discharges.
