12.32.010 - Definitions.

As used in this chapter, the words and phrases contained in this section are defined as follows:

A. "Maintenance equipment" means lawn mowers, sprinklers, and other equipment used in maintaining the park.

B. "Park" means any real property owned or leased or otherwise controlled by the city and which may legally be used for public recreation purposes and has been so designated.

C. "Park authority" means the city manager or his or her designee who is authorized to exercise the powers and perform the duties pursuant to this chapter.

D. "Park equipment" means play equipment, trash receptacles, benches, tables, barbecue equipment, fencing or any other equipment designated for park use.

E. "Park facilities" means restrooms, fountains or other structures located on park properties.

F. "Park property" means soil, plants, trees, walks, rocks, lakes, waterways and the like.

12.32.020 - Prohibited acts—Generally.

While on or in any park, no person shall:

A. Throw any rock, stick, missile, or any other object that may endanger patrons or property;

B. Make a fire in any place except where specifically designated for such purposes by the park authority;

C. Place or cause to be placed any litter, trash, rubbish, waste or filth of any kind except in receptacles provided for such purposes;

D. Conduct or attend an assembly or public demonstration except with prior permission of the park authority;

E. Use loud speakers, amplifiers or hold concerts or dances without prior permission of the park authority;

F. Take up, remove, cut, mutilate or burn or carry away park property;

G. Offer for sale, barter or trade any item without the proper license and prior permission of the park authority;

H. Post or affix any handbill, poster or circular without prior permission of the park authority;

I. Climb, deface or destroy any park facility or maintenance equipment;

J. Bathe or wade in park fountains.

12.32.030 - Camping prohibited.

No overnight camping or sleeping shall be allowed in city parks except with prior permission of park authority.

12.32.040 - Vehicles.

A. No bicycle riding or skateboards are allowed in city parks except on designated paths or trails.

B. No motorized go-carts, bikes or vehicles of any kind shall be allowed in city parks except on designated roadways.

C. No person shall bring, land, or cause to descend or alight any airplane, dirigible, balloon, parachute or other apparatus, designed or used for aviation without the express permission of the park authority in advance.

D. No gasoline powered model planes or autos shall be allowed except in designated areas.

12.32.050 - Animals.

A. Horses shall be prohibited from the park except on prescribed bridle paths or trails.

B. Dogs shall not be permitted in any city park except on a leash no longer than six feet in length and then only in designated areas.

12.32.060 - Addition or deletion of facilities.

The park authority shall make recommendations to the city council with regard to the addition or deletion of any permanent or temporary park facility.

12.32.070 - Use of equipment.

A. No person shall use park equipment in a manner that is hazardous to others or could damage, injure or destroy said equipment.

B. No person shall violate the rules and regulations as posted in that area of the city park known as the "Tot Lot."

C. No group, organization or commercial enterprise shall consistently utilize park equipment in such a manner as to regularly exclude others from use of said equipment.

D. No child under the age of eight years shall be left unattended in any city park.

E. Horseshoes, bows and arrows and other gaming equipment shall be used only in designated areas.

12.32.080 - Hours.

A. Designated. Except as provided herein and within Section 12.32.080(B), all parks are open from six a.m. until ten p.m. Except as provided in Section 12.32.080(B), no person shall enter, remain in, cross upon or use, any park, park facility or portion thereof, between the hours of ten p.m. and six a.m.

Notwithstanding the foregoing, the strip park situated adjacent to the south side of Hwy 20, west of S. Main Street and east of Harmon Lane ("the Hwy 20 Park") shall only be open for public use from sunrise until sunset. Except as provided within Section 12.32.080(B), no person shall enter in, remain in, cross upon or use the Hwy 20 Park or any portion thereof between sundown and sunrise.

B. Exceptions.

  1. At any time the park authority, or a police officer, may exclude any person(s), whether or not such persons are permit holders, from parks, building, or portions thereof, where such exclusion is necessary to protect public property, the public health, safety or welfare or to preserve the public peace.

  2. Whenever any park, building or portion thereof, has been reserved for exclusive use of a permit holder, that area may be closed to all others not associated with that permit holder's exclusive use.

  3. At any time, no person(s), whether or not a permit holder, shall remain in or refuse to leave any park, park facility or any portion thereof, after being advised by the park authority or a police officer, that it is closed or after being excluded under Section 12.32.080(B)(1).

  4. A permit holder may use the park, building or portion thereof beyond regular hours if allowed under the permit holder's permit.

  5. Regardless of the park and park facility hour restrictions, a person may use lighted parks, facilities or portions thereof, under the conditions posted and as specifically designated by the park authority. No person shall use any park, building, or portion thereof, in violation of such posted hours and conditions.
