5.15.010 - Definitions.¶
The following definitions shall apply to terms used in this chapter:
A. Garage Sale. "Garage sale" means any sale of personal property in, at, or upon premises that are residentially zoned or residentially occupied. This definition includes without limitation sales of personal property from the garage, driveway, yard, patio or house areas of such premises.
B. "Person" means person, group of persons, corporation, partnership, association, or firm.
C. Sale. "Sale" means the sale and purchase of personal property, and the advertising, offering or displaying of personal property for purposes of promoting the sale and purchase of that property by members of the general public.

5.15.020 - Noncomplying sales prohibited.¶
It shall be unlawful for any person to sell, or participate in the sale of, personal property to the general public by means of a garage sale, except as permitted by this chapter.

5.15.030 - Exemptions.¶
This chapter shall not apply to garage sales or other sales that are:
A. Sales conducted by religious organizations or charitable organizations, provided that the proceeds from such sales are used solely for religious or charitable purposes;
B. Sales lawfully conducted pursuant to proceedings under local, state or federal law, or by order of a court of competent jurisdiction; or
C. Sales lawfully conducted by legal, nonconforming commercial uses within a residential zone.

5.15.040 - Nonbusiness sales only.¶
No person shall sell, or participate in the sale of, personal property at a garage sale that was purchased or acquired for the purposes of resale.

5.15.050 - Frequency, duration and hours of sales.¶
A. No person shall conduct a garage sale for longer than three consecutive days, or two consecutive weekends, and each such period shall constitute a single "garage sale event."
B. No more than four garage sale events shall be conducted at the same street address, or by the same person, within the same twelve-month period.
C. No person shall conduct any portion of a garage sale event between the hours of six p.m. and eight a.m.

5.15.060 - Displays and inspection.¶
A. All activities associated with a garage sale, including without limitation sales, displays and advertising, shall be conducted entirely upon the residentially zoned or residentially occupied premises in accordance with all applicable provisions of this code, and no such activities shall be conducted upon any street, sidewalk or other public right-of-way.
B. All activities associated with a garage sale, including without limitation sales, displays and advertising, shall be located and conducted so as to provide access by fire and police personnel and health officials for purposes of inspection and emergency response at all times.

5.15.070 - Signs and advertising.¶
Signs advertising a garage sale shall be posted only within the residentially zoned or residentially occupied premises upon which the garage sale is or will be held, and no more than two signs, not exceeding four square feet in sign area each, may be posted. Signs advertising a garage sale must comply with the regulations in Chapter 17.11 of Title 17, and it is unlawful to post any such sign in a public street or right-of-way or on any public property, including without limitation street sign poles and utility poles.

5.15.080 - Violations.¶
Any person who violates the regulations in this chapter is guilty of an infraction and, upon conviction thereof, shall be subject to the penalties provided in Chapter 1.12 of Title 1.
