Westminster Municipal Code Ch. 1.13 Criminal Justice Administration Fee

§ 1.13.010. Fee imposed upon booking or detention.

A. Any person who is arrested by an officer or agent of the city of Westminster or who is booked or processed to the detention facility of the city of Westminster, and who is subsequently convicted of any offense related to the arrest, other than an infraction, shall pay to the city a criminal justice administration fee, for reimbursement of administrative expenses incurred by the city in connection with the arrest and/or booking or processing.

B. The administration fee shall consist of actual administrative costs. "Actual administrative costs" may include any one or more of the following as related to receiving an arrestee into the city detention facility:

  1. The searching, wristbanding, clothing, fingerprinting, photographing, and medical and mental screening of an arrestee;

  2. Document preparation, retrieval, updating, filing, and court scheduling related to receiving an arrestee into the detention facility;

  3. Warrant service, processing, and detainer;

  4. Inventory of an arrestee's money;

  5. Inventory and storage of an arrestee's property;

  6. Inventory and storage of an arrestee's clothing;

  7. The classification of an arrestee;

  8. The direct costs of automated services utilized in subsections 1 to 7, inclusive;

  9. Unit management and supervision of the detention function as related to subsections 1 to 8, inclusive.

C. The amount of the fee shall be in accordance with a fee schedule adopted from time to time by resolution of the city council. The resolution shall itemize the services provided pursuant to subsection B of this section, and the cost for each service.

§ 1.13.020. Fee imposed upon release on person's own recognizance.

A. An administrative screening fee of twenty-five dollars shall be collected from each person arrested and released on his or her own recognizance upon conviction of any criminal offense related to the arrest other than an infraction.

B. A citation processing fee in the amount of ten dollars shall be collected from each person cited and released by any peace officer in the field or at a jail facility upon conviction of any criminal offense, other than an infraction, related to the criminal offense cited in the notice to appear.

§ 1.13.030. Fee collection.

If the judgment of conviction includes an order for payment of the criminal justice administration fee owed to the city, it may be collected by any means provided by law for the enforcement of judgments. If the judgment of conviction fails to include an order for payment of the criminal justice administration fee, the city attorney may either obtain amendment of the judgment or the city may prosecute a civil action to collect the debt.

§ 1.13.040. Use of fees.

All fees collected pursuant to this chapter shall be deposited into the general fund and may be used for any lawful purpose.
