§ 19.00.001. Citation.

This title shall be known as, and may be cited and referred to, as the "Nuisance Abatement Code."

§ 19.00.002. Application.

This code applies generally to all real and personal property within the city of West Sacramento.

A. Every owner of real and personal property within the city is required to maintain such property in accordance with the provisions of this code, and such owner shall be liable for violations of this code regardless of any contract or agreement that the owner might have with a third party regarding the property.

B. Every legal occupant, lessee or other person with an interest in real property, with the exception of a property owner or a lender whose sole interest in the property is as security for the repayment of a debt, is required to maintain such property in the same manner as is required of the property owner. The duty imposed on a property owner shall, in no instance, relieve legal occupants, lessees, or other persons of their duties under this code.

§ 19.00.003. Severability.

If any chapter, article, section, subsection or subdivision thereof, provision, sentence, clause or phrase of this code, or any application thereof, is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the remaining provisions of this code which can be given effect without the invalid portions and, therefore, such invalid portions are declared to be severable. The city council hereby declares that it would have enacted this code and each of its chapters, articles, sections, subsections or subdivisions thereof, provisions, sentences, clauses or phrases irrespective of the fact that one or more of them is declared invalid.

§ 19.00.004. Reference.

Whenever reference is made to any portion of this code, the reference applies to this code as adopted and any subsequent amendments or additions.

§ 19.00.005. Continuity of provisions.

The provisions of this code, insofar as they are substantially the same as previously existing city municipal code provisions relating to the same subject matter, shall be construed as restatements and continuations thereof and not new enactments. Any actions or proceedings commenced, permits issued, or entitlements granted pursuant to any prior existing ordinance or city municipal code provisions, shall not be affected by the enactment of this code; but such actions, proceedings, permits and entitlements shall hereafter conform to this code.

§ 19.00.006. Nonexclusive remedies.

The remedies provided in this code are cumulative, and shall be in addition to any other remedies provided by law. Nothing in this code shall be deemed to prevent the city from commencing any other available civil or criminal proceeding to abate a nuisance under applicable provisions of state or other law.
