§ 15.07.010. Purpose and intent.

The stated intent of this chapter is as follows:

A. To ensure that the city remains informed of rent increases at mobile home parks; and

B. To encourage park owners to enter into long-term rental agreements with park tenants in order to stabilize rents for mobile home park sites.

§ 15.07.020. Definitions.

"Mobile home"

means a structure meeting the definition set forth in California Civil Code Section 798.3.

"Mobile home park"

means any land where two or more mobile home sites are rented or held out for rent to accommodate mobile homes used for human habitation. A mobile home park shall not include a mobile home subdivision or stock cooperative. A mobile home park is not a recreational vehicle park as defined in California Health and Safety Code Section 18862.39.

"Mobile home site"

means an area within a mobile home park being occupied by or designated for occupancy by an individual mobile home.

"Park owner"

means a person or entity that has a controlling ownership interest in a mobile home park.

"Park tenant"

means a person who rents a mobile home site within a mobile home park.

"Rent increase notice"

means a written notification of a rent increase provided by a park owner in accordance with Section 15.07.030 of this chapter, on a form provided by the city.

§ 15.07.030. Rent increase notice.

A. A park owner shall provide the city with a rent increase notice whenever the rent on any park tenant in any mobile home park in the city is increased by any amount; and

B. A park owner shall file such notice with the city manager not fewer than ninety days before the rent increase is to take effect; and

C. At a minimum, each rent increase notice for each site shall include the following and any additional information as may be required by this chapter or the city manager or designee:

  1. Current site rent (before rent increase);

  2. The amount of the rent increase;

  3. The effective date of the rent increase;

  4. The reason for the rent increase;

  5. The address and number of the mobile home site subject to the noticed rent increase; and

  6. The date(s) and amount(s) of each rent increase within the twelve-month period prior to the rent increase notice (if none, the date and amount of the previous rent increase) for the affected mobile home site.

§ 15.07.040. Monitoring.

The city shall use the information contained in the rent increase notices to monitor rent increases within mobile home parks. Staff shall maintain a written record of mobile home park site rent increases for the purpose of measuring the effectiveness of the city's mobile home park site rent stabilization efforts.

§ 15.07.050. Sunset.

This chapter is repealed when the city council approves a final report prepared by city staff that concludes that the goal of mobile home park site rent stabilization has been substantially accomplished.

§ 15.07.060. Enforcement.

Noncompliance with the requirements of this chapter shall be considered a misdemeanor per Section 1.12.010 of this code.
