§ 5-9.101. Definitions.

For the purposes of this chapter only, the following words and phrases shall have the meanings defined in this section unless the context clearly requires otherwise:

(a) "Gasoline-powered" means any item or equipment that is powered by an internal combustion engine that runs on gasoline, diesel, or other volatile fuel.

(b) "Leaf blower" means a machine, powered by a gasoline engine or electric motor, used to blow, displace, or vacuum leaves, dirt and/or debris.

§ 5-9.102. Prohibition against use of gasoline powered leaf blowers.

It is prohibited for any person, business or entity who owns, manages or rents property in the City to:

(a) Use or operate any gasoline powered leaf blower in the City; or

(b) To hire, allow, employ or retain the service of a person or business to use gasoline powered leaf blowers on the property.

§ 5-9.103. Exemptions.

Use of gasoline powered leaf blowers is exempt from this section as follows:

(a) When utilized by or at the direction of emergency responders for the purposes of responding to an emergency, or necessary to restore, preserve, protect, or save lives or property from imminent danger of loss or harm; or

(b) When used to clear downed trees or vegetation in areas needing expedient clearance when necessary to protect public safety, as authorized by the City.

§ 5-9.104. Use of leaf blowers generally.

Subject to the restrictions of this chapter and § 4-6.203(g), the use of leaf blowers is otherwise permitted within the City limits.

§ 5-9.105. Authority and enforcement.

(a) Authority and enforcement of this chapter shall be enforced as prescribed in chapter 1-2 of the Walnut Creek Municipal Code.

(b) Each violation of this chapter shall be considered a separate offense. A violation determined to be an infraction is punishable by (1) a fine not exceeding one hundred dollars ($100) for a first violation; (2) a fine not exceeding two hundred dollars ($200) for a second violation of the same chapter within one year; (3) a fine not exceeding five hundred dollars ($500) for each additional violation of the same chapter within one year.
