10.28.010 Definitions.¶
The following definitions should apply in this chapter:
A. Cruise or Cruising. Cruising is defined as driving a motor vehicle on a highway past a traffic control point designated by the ranking peace officer on duty, under conditions in which traffic is congested at or near the control point, three or more times within a two-hour period, after having driven past said control point twice within the same period and having been given adequate written notice after the second passing, that passing the control point a third time under conditions stated herein shall constitute a violation of this section.
B. Highway and Motor Vehicle. “Highway” and “vehicle” are defined by Sections 360 and 415 of the California Vehicle Code, respectively.
C. South Mooney Boulevard. The street that is also known as State Route 63, bounded on the north by Noble Avenue, and on the south by Caldwell Avenue. (Prior code § 3400)
10.28.020 Cruising prohibited.¶
A. As per California Vehicle Code Section 21100(k), cruising shall be prohibited on South Mooney Boulevard.
B. No person shall be guilty of cruising unless that person has been driving a motor vehicle past the same traffic control point three or more times within a two-hour period and has, upon driving past the traffic control the first time, been given notice that further driving past the traffic control point shall be a violation of the Visalia Municipal Code. 10.28.030 Exclusions.¶
This chapter shall not apply to emergency vehicles in service, taxicabs for hire and buses operated by a government agency and traveling along a fixed route. (Prior code § 3402)
10.28.040 Penalty.¶
A violation of the provisions of this chapter shall be an infraction punished as follows:
A. The minimum penalty for a first conviction of cruising is a twenty-five dollar ($25.00) fine;
B. For a second violation occurring within one year of a prior violation that resulted in conviction, a fine not exceeding fifty dollars ($50.00);
C. For a third or any subsequent violation occurring within one year of two or more prior violations resulting in convictions a fine not exceeding one hundred dollars ($100.00). (Prior code § 3403)
10.28.050 Severability.¶
If any section, subsection, sentence, clause or phrase of this chapter is for any reason held to be unconstitutional, such decision shall not affect the remaining portions of this chapter. The city council declares that it would have passed this chapter and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional.
