Sec. 7-2.1. - Intent and Purpose.

The purpose and intent of this chapter is to provide guidance and standards with regard to the storage, keeping, and disposal of animal waste within the community.

Sec. 7-2.2. - Definitions.

"Animal" means any multi-celled living creature other than plants and humans, including, but not limited to, horses, llamas, cows, goats, birds, cats, dogs, fish, fowl, rabbits, and reptiles.

"Manure" means discharge from confinement facilities, kennels, pens and recreational facilities, including stables.

"Premises" means any lot or parcel of land owned, leased or rented by a person.

"Sanitize" means to make physically clean, remove and destroy to a practical minimum agent injurious to health.

Sec. 7-2.3. - Maintenance.

The occupant of any premises on which any animal is kept shall keep and maintain the animal(s) and premises in such a manner as not to be detrimental to the health, safety, or welfare of any person on any adjoining property or of the general public, nor be materially detrimental to the use, enjoyment, or value of property of other persons in the vicinity of the premises. Such maintenance shall be at least sufficient to keep dust, odors, flies and noise from having an adverse effect on any other property.

The following techniques are required to meet the maintenance standards specified by this section and shall be utilized if no other alternative techniques sufficient to meet the standard are utilized:

  1. All manure shall be removed from the ground and stalls at least once in every 24-hour period and placed in a covered trash container. All manure shall be removed from the premises or composted at least once every seven days.

  2. Chemical spray and/or bait shall be utilized as frequently as necessary for fly control.

  3. Either automated devices will be utilized or manual treatment regularly applied for animal drinking water in troughs in order to minimize the potential for mosquitos.

  4. An unreasonable accumulation of manure, standing surface water and refuse in any animal enclosure including a corral or stable area constitutes a health hazard. Therefore, animal enclosures, corrals and stable areas shall be maintained in a clean and sanitary condition at all times and standing surface water, refuse and manure shall not be permitted to accumulate. Proper storage and disposal of manure must eliminate or minimize the potential of runoff containing pollutants and leaching of nutrients into groundwater or surface waters from areas where manure accumulates or is temporarily stored. Manure storage, whether in a cart, dumpster bin, roll-off box or constructed structure, shall be stored at least thirty-five (35) feet from the nearest neighboring dwelling unit.

  5. Manure storage areas shall be constructed in such a manner as to minimize potential runoff. No manure storage structure or container shall be placed within ten (10) feet of a flood control channel or open storm drain.

  6. Manure runoff which discharges onto adjacent property, onto City streets, horse trails, or into flood control channels is prohibited, and allowing such to occur, intentionally or negligently, shall be in violation of Chapter XX (Water Quality), Section 20-1.4 of the Villa Park Municipal Code.
