16.210.010 Application of regulations.

A. The provisions of this title prohibiting the stopping, standing or parking of a vehicle shall apply at all times or at those times herein specified, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.

B. The provisions of this title imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the Vehicle Code or the ordinances of this city prohibiting or limiting the standing or parking of vehicles in specified places or at specified times. 16.210.030 Traffic engineer to maintain no stopping zones and no parking areas.

The city traffic engineer, with the approval of the city manager, is hereby authorized to maintain, by appropriate signs or by paint upon the curb surface, all no stopping zones, no parking areas, and restricted parking areas, as defined and described in this title.

When said curb markings or signs are in place no operator of any vehicle shall stop, stand or park such vehicle adjacent to any such legible curb marking or sign in violation of any of the provisions of this title. (Code 1971, § 7213)

16.210.040 No parking areas.

A. Designated. No operator of any vehicle shall stop, stand, park, or leave standing such vehicle in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or other authorized officer, or traffic sign or signal:

  1. Within any divisional island unless authorized and clearly indicated with appropriate signs or markings.

  2. On either side of any street between the projected property lines of any sidewalk or street terminating at such street, when such area is indicated by appropriate signs or by red paint upon the curb surface.

  3. In any area where the city traffic engineer, with the approval of the city manager, determines that the parking or stopping of a vehicle would constitute a traffic hazard or would endanger life or property, when such area is indicated by appropriate signs or by red paint upon the curb surface.

  4. In any area established by resolution of the council as a no parking area, when such area is indicated by appropriate signs or by red paint upon the curb surface.

  5. Upon, along or across any railroad track in such manner as to hinder, delay, or obstruct the movement of any car traveling upon such track.

  6. In any area where the parking or stopping of any vehicle would constitute a traffic hazard or would endanger life or property.

  7. On any street or highway where the use of such street or highway or a portion thereof is necessary for the cleaning, repair or construction of the street or highway or the installation of underground utilities or where the use of the street or highway or any portion thereof is authorized for a purpose other than the normal flow of traffic or where the use of the street or highway or any portion thereof is necessary for the movement of equipment, articles or structures of unusual size, and the parking of such vehicle would prohibit or interfere with such use or movement; provided, that signs giving notice of such no parking are erected or placed at least 24 hours prior to the effective time of such no parking.

  8. At any place within 30 feet or a point on the curb immediately opposite the mid-block end of a safety zone, when such place is indicated by appropriate signs or by red paint upon the curb surface.

  9. At any place within 30 feet of a crosswalk at an intersection in the central traffic district or in any business district when such place is indicated by appropriate signs or by red paint upon the curb surface except that a bus may stop at a designated bus stop.

  10. Within 30 feet of the approach to any traffic signal, boulevard stop sign, or official electric flashing device.

B. Moving Vehicle Into Prohibited Area. No person shall move a vehicle not lawfully under the person’s control into any such prohibited area or away from a curb such a distance as is unlawful.

C. Use of Streets for Storage of Vehicles Prohibited.

  1. No person who owns or has possession, custody or control of any vehicle shall park such vehicle upon any street or alley for more than a consecutive period of 72 hours.

  2. Removal of Vehicle. In the event a vehicle is parked or left standing upon a street in excess of a consecutive period of 72 hours, the police department may remove said vehicle from the street in the manner and subject to the requirements of Sections 22650 through 22653 and 22850 through 22854 of the Vehicle Code.

D. Parking of Commercial Vehicles in Residential Zones. No person shall park or leave standing any commercial vehicle more than five hours on any public street in any residential district in the city except:

  1. While loading or unloading property; or

  2. When such vehicle is parked in connection with, and in aid of, the performance of a service to or on a property in the block in which such vehicle is parked; or

  3. As provided in Section 22507.5(a) of the Vehicle Code.

Vehicles parked pursuant to subsections (D)(1), (D)(2), and (D)(3) of this section may be parked for five hours plus such time in addition thereto as is reasonably necessary to complete such work or services.

For purposes of this section, the term “commercial vehicle” means a commercial vehicle as defined in Section 260 of the Vehicle Code that has a manufacturer’s gross vehicle weight rating of 10,000 pounds or more; and the term “residential district” means a zone or subzone established pursuant to the provisions of Title 24 that has a letter “R” in the zone or subzone designation or classification. 16.210.050 Parking on private property or fire lines prohibited.

A. Private Property. No person shall park a vehicle in a private driveway or on private property without the direct or implied consent of the owner or person in lawful possession of such driveway or property.

B. Parking or Storage in Fire Lanes.

  1. It shall be unlawful to park any vehicle or trailer or to store any equipment or other matter in any fire lane that has been established and designated, with the approval of the city fire chief, either on public or private property.

  2. The provisions of this section may be enforced by the city fire department by citation or complaint or both. (Code 1971, § 7215)

16.210.060 Parking for certain purposes or in certain places prohibited.

A. Reserved.

B. Maintenance. No person shall perform maintenance or repairs upon a vehicle parked upon a street except temporary repairs necessitated by an emergency. No person shall park a vehicle upon a roadway when such vehicle is not in operable condition by reason of damage thereto or missing parts or other cause except when necessitated by an emergency. For the purpose of this section, maintenance includes greasing or repairing a vehicle.

C. Washing or Polishing Vehicles. No person shall wash or cause to be washed, polish or cause to be polished any vehicle or any part thereof upon any public street in this city, when a charge is made for such service.

D. Parking Adjacent to Schools.

  1. The city traffic engineer, with the approval of the city manager, is hereby authorized to erect signs indicating no parking upon that side of any street adjacent to any school property when such parking would, in their opinion, interfere with traffic or create a hazardous situation.

  2. When official signs are erected prohibiting parking upon that side of a street adjacent to any school property, no person shall park a vehicle in any such designated place.

E. Parking Prohibited on Narrow Streets.

  1. The city traffic engineer, with the approval of the city manager, is hereby authorized to place signs or markings indicating no parking upon any street when the width of the roadway does not exceed 20 feet, or upon one side of a street as indicated by such signs or marking when the width of the roadway does not exceed 30 feet.

  2. When official signs or markings prohibiting parking are erected upon narrow streets as authorized herein, no person shall park a vehicle upon any such street in violation of any such sign or marking.

F. Standing or Parking on One-Way Streets. The city traffic engineer, with the approval of the city manager, is authorized to erect signs upon either side of any one-way street to prohibit the standing or parking of vehicles, and when such signs are in place, no person shall stand or park a vehicle upon either side in violation of any such sign.

G. Standing or Parking on One-Way Roadways. In the event a highway includes two or more separate roadways and traffic is restricted to one direction upon any such roadway, no person shall stand or park a vehicle upon the left-hand side of such one-way roadway unless signs are erected to permit such standing or parking. The city traffic engineer, with the approval of the city manager, is authorized to determine when standing or parking may be permitted upon the left-hand side of any such one-way roadway and to erect signs giving notice thereof.

H. No Stopping, Standing or Parking Near Hazardous or Congested Places.

  1. The city traffic engineer, with the approval of the city manager, is hereby authorized to determine and designate by proper signs places in which the stopping, standing or parking of vehicles would create an especially hazardous condition or would cause delay to traffic.

  2. When official signs are erected at hazardous or congested places as authorized herein, no person shall stop, stand or park a vehicle in any such designated place.

I. Parking so as Not to Obstruct Traffic. No person shall park a vehicle upon a street in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for the free movement of vehicular traffic.

J. Parking on Grades. No person shall park or leave standing any vehicle unattended on a street or alley when upon any grade exceeding three percent within any business or residence district without blocking the wheels of said vehicle by turning them against the curb to prevent downgrade movement, and by setting the hand brake.

K. Parking Prohibited for Street Sweeping.

  1. The city traffic engineer is hereby authorized to determine whether street conditions in a given location necessitate parking restrictions to facilitate street sweeping operations. If the city traffic engineer determines that such restrictions are necessary, the traffic engineer may cause proper signs to be erected upon the side of any street to prohibit parking during certain hours for purposes of allowing street sweeping.

  2. When official signs are erected at a location prohibiting parking for purposes of facilitating street sweeping, no person shall park a vehicle in any such location in violation of the posted parking restrictions.

L. Parking Prohibition, 10:00 p.m. to 6:00 a.m.

  1. The city traffic engineer, with the approval of the city manager, is hereby authorized to determine if conditions in a given location necessitate a nighttime restriction, to determine the time period of the nighttime restriction, and to erect proper signs upon any street to prohibit parking between the hours of 10:00 p.m. and 6:00 a.m., in the public interest or for the benefit or convenience of adjacent residences or businesses.

  2. When official signs are erected at a location to prohibit nighttime parking, as authorized herein, no person shall park a vehicle in any such location in violation of the posted parking restrictions. (Code 1971, § 7216; Ord. No. 2000-07, § 1, 2-7-00)

16.210.070 City parking lots.

A. Establishment of Rules and Regulations. The city council may by resolution establish rules and regulations for the parking of vehicles in any parking lot owned or operated by the city, or the city traffic engineer, with the approval of the city manager, is authorized to determine and post rules and regulations for the parking of vehicles in any parking lot owned or operated by the city.

B. Observance of Regulations. When signs are in place giving notice thereof, no person shall park a vehicle in any such parking lot for a period of time longer than is permitted by such signs, nor shall any person park a vehicle in any manner contrary to the instructions of a sign placed in accordance with this title.

C. Blocking Exits Prohibited. No person shall stop, stand or park any vehicle in a city-owned or city-operated parking lot so that such vehicle has to be moved in order to move any other vehicle, or so that such vehicle blocks an exit of the lot. (Code 1971, § 7217)

16.210.080 Unlawful parking – Peddlers, vendors, trailers.

A. Except as otherwise provided in this section, no person shall stand or park any vehicle, wagon or pushcart from which goods, wares, merchandise, fruits, vegetables or foodstuffs are sold, displayed, solicited or offered for sale or bartered or exchanged, or any lunch wagon or eating cart or vehicle, on any portion of any street within this city except that such vehicles, wagons or pushcarts may stand or park only at the request of a bona fide purchaser for a period of time not to exceed 10 minutes at any one place. The provisions of this subsection shall not apply to persons delivering such articles upon order of, or by agreement with, a customer from a store or other fixed place of business or distribution.

B. No person shall park or stand on any street any lunch wagon, eating cart or vehicle, or pushcart from which food, drink or other articles of food are sold or offered for sale without first obtaining a written permit to do so from the city traffic engineer which shall designate the specific location in which such cart shall stand.

C. No person shall park or stand any vehicle or wagon used or intended to be used in the transportation of property for hire on any street while awaiting patronage for such vehicle or wagon without first obtaining a written permit to do so from the city traffic engineer which shall designate the specific location where such vehicle may stand.

D. Whenever any permit is granted under the provisions of this section and a particular location to park or stand is specified therein, no person shall park or stand any vehicle, wagon or pushcart on any location other than as designated in such permit. In the event that the holder of any such permit is convicted in any court of competent jurisdiction for violating any of the provisions of this section, such permit shall be forthwith revoked by the city traffic engineer upon the filing of the record of such conviction with such officer and no permit shall thereafter be issued to such person until six months have elapsed from the date of such revocation. 16.210.090 Emergency parking signs.

A. Whenever the city traffic engineer or chief of police shall determine that an emergency traffic congestion is likely to result from the holding of public or private assemblages, gatherings, or functions, or for other reasons, the city traffic engineer or chief of police shall have power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys as the city traffic engineer or the chief of police shall direct during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency, and the city traffic engineer or the chief of police shall cause such signs to be removed thereafter.

B. When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs. (Code 1971, § 7219)
