Truckee Municipal Code Ch. 9.15 Fireworks and Outdoor Fires

9.15.010 - Definitions.

For the purpose of this Chapter unless it is plainly evident from the context that a different meaning is intended, the following terms are defined as follows:

(a) "Campfire" means an outdoor fire which is used for cooking, personal warmth, ceremonial or aesthetic purposes including portable barbecue pits. "Campfire" does not include portable lanterns designed to emit light resulting from a combustion process or commercially manufactured stoves.

(b) "Fireworks" means any device described in California Health & Safety Code Sections 12505 and/or 12511, as those sections may be amended or superseded from time to time.

(c) "Land" includes any public or private property within the Town of Truckee including, but not limited to, streets, sidewalk, alleys, and improved or unimproved parcels.

9.15.020 - Property Owner Consent Required for Fires.

No person who is not the owner or lessee of land shall ignite or maintain a campfire or cause a campfire to be lit on that land without the written permission of the owner, lessee, or agent of the owner or lessee of the land. Notwithstanding the foregoing, no written permission shall be required for campfires lit or maintained in officially designated campgrounds provided such campfires are in compliance with all applicable campground rules.

9.15.030 - Dangerous Campfires Prohibited.

No campfire shall be maintained or allowed to exist which is unreasonably large, causes a hazard to the surrounding area, or is constructed in such a fashion that the fire cannot be reasonably and safely contained.

9.15.040 - Extinguishment Required.

Any campfire kindled within the Town of Truckee shall be constantly observed and attended by the person(s) responsible for the campfire, in a manner that allows person(s) to have immediate control over the fire and the ability to contain and control the fire as necessary to avoid it becoming a dangerous campfire. Every campfire shall be completely extinguished, including extinguishment of all coals and embers, before the campfire is left unattended.

9.15.050 - Use of Fireworks Prohibited.

No person, firm, or business entity shall use, discharge, or possess any fireworks within Town limits except in compliance with a valid permit for such use, discharge, and/or possession issued by the Truckee Fire Protection District.

9.15.060 - Violations of This Chapter.

Any person violating any provision of this chapter is guilty of a misdemeanor.
