7.04.150 - Construction moratorium.¶
No permit will be issued by the Public Works Department to any person, firm or corporation either as principal, agent or employee to do any construction in the major streets and in the downtown areas during the holiday season. This restriction shall be applicable to all arterials and downtown areas during the holiday season which are defined as follows:
(a) Arterials will be defined as those streets identified in the City's General Plan as major or minor arterials in the City going from east to west and north to south City limits.
(b) The downtown area is defined as that area located between 6th and 12th Street and between West Street and MacArthur Drive.
(c) Holiday season: that period between the Monday preceding Thanksgiving and January 2.
Any person, firm or corporation doing construction in the above defined areas will either complete the construction prior to the holiday season or stop work and make it safe to the satisfaction of the Director of Public Works or his appointed designee. Construction will be allowed to resume only after the holiday season is over.

7.04.160 - Prohibitions.¶
Exception to this moratorium shall be only limited to the conditions listed in Section 7.04.080 of the Tracy Municipal Code. In such cases a permit shall be required from the Public Works Department and the decision of the Director of Public Works to allow or deny shall be final.

7.04.170 - Fees and penalties.¶
Any person, firm or corporation found in violation of this article shall be fined One Thousand and no/100ths ($1,000.00) Dollars per calendar day and shall be ordered to stop work immediately and correct the conditions to the satisfaction of the Director of Public Works within a specified period of time as determined by the Director of Public Works. If the contractor does not correct the conditions within the specified period of time, the Public Works Department shall correct and make safe the conditions and back charge the contractor. The decision of the Director of Public Works or his designated representative shall be final.
