1300-010 - TITLE

This chapter shall be known and cited as "the Sutter County Building Code".

1300-020 - PURPOSE

The Board of Supervisors expressly finds that the provisions of this Chapter and of the codes adopted hereby constitute minimum standards for the protection of the public health, public safety, and public welfare and to provide minimum standards for the proper regulation of building construction.

1300-030 - AUTHORITY

This chapter is adopted pursuant to the authority granted by Section 7 of Article XI of the Constitution of the State to a county to make and enforce within its limits all such local, police, sanitary, and other regulations as are not in conflict with general laws; and pursuant to the authority granted by California Health and Safety Code Section 17960 which requires counties to enforce all provisions published in the State Building Standards Code as adopted by the California Building Standards Commission. It is further adopted in conformity with the state government code relating to adoption of codes by reference.

1300-040 - APPLICABILITY

This chapter shall apply within all the unincorporated territory of the county. The building code of this county is the 2025 California Building Code (California Code of Regulations, Title 24, Part 2, Volumes 1 and 2), the 2025 California Mechanical Code (California Code of Regulations, Title 24, Part 4), the 2025 California Plumbing Code (California Code of Regulations, Title 24, Part 5), the 2025 California Electrical Code (California Code of Regulations, Title 24, Part 3), the 1997 Uniform Housing Code, the 2025 California Residential Code (California Code of Regulations, Title 24, Part 2.5), the 2025 California Energy Code (California Code of Regulations, Title 24, Part 6), the 2025 California Green Building Code (California Code of Regulations, Title 24, Part 11), the 2025 California Administrative Code (California Code of Regulations, Title 24, Part 1), and the California Reference Standard Code (California Code of Regulations, Title 12), as amended by the changes, additions, and deletions set forth in this chapter.

1300-091 - MODIFICATIONS TO THE UNIFORM HOUSING CODE, 1997 EDITION

Modifications to the Uniform Housing Code, 1997 Edition are as follows:

(a) Section 201.1, is hereby amended to read as follows:

201.1 - Authority. The Building Official is hereby authorized and directed to enforce all the provisions of this code. For such purpose, he shall have the powers of a law enforcement officer. Whenever the term "Building Official" is used in this code, it shall mean "Health Officer" with regard to maintenance, sanitation, or ventilation.

1300-150 - TERRITORIAL APPLICABILITY AND ENFORCEMENT

The provisions of this chapter shall apply to all of the unincorporated territory of the County of Sutter and shall be enforced by the Sutter County Building Official.

1300-160 - PENALTIES

It shall be unlawful for any person, firm, corporation, or other entity of any nature, whether as owner, lessee, architect, contractor, artisan, or otherwise to make any installation, alterations, or repair, or to permit, cause or favor the same to be done or to perform any other act contrary to or in violation of any of the provisions of this chapter or of the uniform codes adopted, and by ordinance made a part hereto; and each such person, firm, corporation, or other entity shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any such provision of this chapter is committed, continued, or permitted, and for each such offense, on conviction thereof, shall be punished in accordance with Chapter 87.
