§ 12.36.010. Consent given for Santa Clara to furnish water to Sunnyvale residents.

Consent is given by the city of Sunnyvale to the city of Santa Clara to supply and provide city of Santa Clara municipal water service to inhabitants in the city limits of the city of Sunnyvale on properties contiguous to and underlying Helen Avenue between the northerly line of El Camino Real and the city of Santa Clara city limits line crossing Helen Avenue north of El Camino Real. This consent is limited to allow Santa Clara to serve the inhabitants of the area defined with the water facilities now owned by California Water Service Company or with substituted Santa Clara city municipal water facilities. The consent is conditional upon and supported by the consideration of the city of Santa Clara providing service to such Sunnyvale residents at Santa Clara's inside as opposed to outside user fees. The consent is further conditioned upon the city of Santa Clara agreeing that in the future city of Sunnyvale may acquire the facilities which service city of Sunnyvale residents from the city of Santa Clara at its then fair market value.
