§ 24.04.010. Fee payment.

A. Prior to the issuance of any building permit, the applicant shall pay to the applicable fire protection district fees adopted by resolution pursuant to this title.

B. Prior to the issuance of any building permit, the applicant shall show proof of payment to the county's department of building and inspection that any fees adopted pursuant to this title and established by resolution of the board of supervisors have been paid. The form of proof of payment shall be determined by the county department of building and inspection.

C. The fee shall be determined by the fee schedule in effect on the date the vesting tentative map or vesting parcel map is approved, or the date a permit is issued.

D. When application is made for a new building permit following the expiration of a previously issued building permit for which fees were paid, the fee payment shall not be required unless the fee schedule has been amended during the interim, in this event the appropriate increase or decrease shall be imposed.

E. In the event that subsequent development occurs with respect to property for which fees have been paid, additional fees shall be required only for additional square footage of development that was included in computing the prior fee.

F. When a fee is paid for a development project and that project is subsequently reduced so that it is entitled to a lower fee, the appropriate fire protection district shall issue a partial refund of the fee.

G. When a fee is paid for a development project and the project is subsequently abandoned without any further action beyond the obtaining of a building permit, the payor shall be entitled to a refund of the fee paid, less the administrative portion of the fee. Any such refund shall be made by the fire protection district which collected the fee.

§ 24.04.020. Fire protection facilities fee account(s).

Fees paid under this title shall be held by the fire protection district in accounts. The fees in said account(s) shall be expended only for the purpose or purposes for which they were collected. The fire protection district shall retain the interest accruing on the fees in said account(s) and shall allocate such interest to the account(s) for which the fees were imposed.

§ 24.04.030. Exemptions.

Fire protection facilities fees shall not be imposed on any of the following:

A. Any replacement or reconstruction of any residential, commercial or industrial development project that is damaged or destroyed as a result of a natural disaster;

B. Any alteration or addition to a specific structure if the square footage of the structure is increased less than ten percent;

C. Any replacement of existing structures, in kind, if the applicant can prove that the structure or facility legally existed before the ordinance was effective;

D. Any replacement, in kind, of structures damaged by fire, flooding, earthquake, etc.

§ 24.04.040. Environmental exemption.

Pursuant to Title 14, Code of Regulations, Sections 15061 and 15273(4), this title is exempt from the California Environmental Quality Act.
