§ 7.15.150. Authority to inspect.

Whenever necessary to make an inspection to enforce any provision of this chapter, or whenever the city manager has cause to believe that there exists, or potentially exists, in or upon any premises any condition which constitutes a violation of this chapter, the city manager may enter such premises at all reasonable times to inspect the same and to inspect and copy records related to storm water compliance. In the event the owner or occupant of said premises refuses entry after a request to enter and inspect has been made, the city is hereby empowered to use any means authorized by law to obtain entry to said premises.

§ 7.15.160. Annual storm water business inspection fee.

Owners of all businesses subject to inspection pursuant to this chapter shall pay an annual inspection fee in the amount set forth by separate resolution of the city council. The annual storm water business inspection fee shall be collected at the same time as the payment of the business's business and professions tax.

§ 7.15.170. Storm water business reinspection fee.

Upon any inspection made by the city pursuant to this chapter, the inspector may instruct the owner or occupant of the business facility to perform work, take action, or refrain from action to ensure compliance with this chapter. If the inspector discovers during the inspection that a violation exists requiring a reinspection to verify compliance, the business owner shall be charged a reinspection fee in an amount set forth by separate resolution of the city council. Should the business owner fail to pay the required fee, the city will recover it, plus any accrued interest and penalties, utilizing any remedies provided by law including but not limited to nuisance abatement or municipal tax lien. Failure to pay the storm water business reinspection fee shall be deemed a violation of this chapter. Violations that were not noted on the initial inspection report due to oversight by the inspector and are corrected within the period specified in the report of inspection shall not be subject to a reinspection fee.
