§ 5.10.010. Definitions.

For the purpose of this chapter the following words and phrases shall mean:

"Garage sale" or "yard sale"

means any event where personal property is displayed for the purpose of selling such property in, at or upon, any residentially zoned property, or any nonresidential zoned properties containing legal residential uses. Such sales shall include, but not be limited to, all such events and the advertising of the holding of any such event, regardless of whether the event is called a yard sale, garage sale, front yard sale, back yard sale, home sale, patio sale, attic sale, tag sale, rummage sale, or any similar designation.

"Personal property"

means all property other than real property.

§ 5.10.020. Restrictions—Penalties.

A. Except as otherwise provided in this chapter, no person shall display for sale any personal property upon any residentially zoned property, or any nonresidentially zoned property, except in connection with a business licensed to conduct retail sales under Chapter 5.04 of this title.

B. No person found violating this chapter may hold a subsequent garage sale.

§ 5.10.030. Display limited.

No person shall place, keep, maintain, store or display personal property sold or offered for sale at any garage sale on or in any public right-of-way.

§ 5.10.040. Times for sales.

Garage/yard sales may be conducted only on the first Saturday of each month. If such Saturday is not available due to an emergency declared by the city, California or the United States, a permittee may conduct the sale on the following Saturday. A permittee may apply to transfer its permit to the second Saturday of the same month on the basis that the weather prevented the resident from conducting the sale on the first Saturday. The city retains the discretion to deny such transfer request.

§ 5.10.045. Permits required.

A resident ("permittee") may apply for a garage/yard sale permit to conduct sales on their property, on the days specified in Section 5.10.040. In order to qualify for a garage/yard sale permit, the resident must fill out the permit application provided by the community development department and provide proof of residency.

§ 5.10.050. Signs.

A. Notwithstanding Chapter 17.62, no person shall post more than two signs advertising a garage sale upon the site conducting the sale. No sign shall exceed six square feet of area on any one side. No person shall post any sign advertising a garage sale anywhere other than on the site conducting the sale. No person shall post or maintain a sign earlier than twenty-four hours immediately preceding the lawful commencement of such garage sale. Each sign shall be removed on or before five p.m. on the last day on which the garage sale may lawfully be conducted pursuant to this chapter.

B. Any person violating subsection A of this section shall be subject to a fine of five dollars for each such unlawful sign.

§ 5.10.060. Exceptions.

The provisions of this chapter shall not apply to any of the following:

A. The sale of personal property pursuant to a court order of judicial process.

B. The sale of personal property by a nonprofit organization if the sale is on property owned by the nonprofit organization and the nonprofit organization provides to the city sufficient documentation of 501(c) status under the Federal Internal Revenue Code.
