Sec. 11B.04.010. - Registration required.

All vineyard and orchard sprinkler frost protection systems within the Russian River watershed shall be registered with the agricultural commissioner prior to use. A separate registration shall be required for each site. Registrations shall be updated within 30 days following any change to the vineyard or orchard sprinkler frost protection system, or to the ownership or control of the site.

Sec. 11B.04.020. - Registration filing and processing.

A. Application. Registration applications shall be filed with the agricultural commissioner on a county application form. Each registration application shall include all required fees, and all information and materials required by the agricultural commissioner, including whether the vineyard or orchard sprinkler frost protection system is part of an approved water demand management program and, if so, the name of the program. No registration application shall be deemed complete, and processing shall not commence on any registration application, until all required fees have been paid, and all required information and materials have been submitted.

B. Registration. Upon receipt of a complete registration application, the agricultural commissioner shall register the vineyard or orchard sprinkler frost protection system or update the system's registration, as appropriate.

C. Eligibility for Filing. A registration application may only be filed by the owner or authorized agent of the owner of the site, or other person with the written consent of the site owner.

D. Inspection. The vineyard or orchard sprinkler frost protection system for which a registration application is filed shall be subject to inspection by the agricultural commissioner to verify the information in the registration application.

E. Ministerial Action. The board of supervisors hereby declares that the review of registration applications and the registration of vineyard and orchard sprinkler frost protection systems pursuant to this chapter shall be ministerial actions. This chapter shall be interpreted, administered, and construed in light of this legislative intent.

Sec. 11B.04.030. - Registration fees.

The board of supervisors shall establish a schedule of fees for the processing of registration applications required by this chapter.
