9.16.010 - Parade defined.¶
For purposes of this chapter, a "parade" is any procession, march, ceremony, show, exhibition, pageant, or similar display in or upon any street or other public place in the city.

9.16.020 - Permit required.¶
Except as provided in Section 9.16.050, it is unlawful for any person to engage in, participate in, or conduct any parade within the city unless a parade permit has been obtained from the chief of police.

9.16.030 - Application for permit.¶
An application for a parade permit shall be filed with the chief of police not less than one day nor more than thirty days before the date on which the parade is to be conducted. The application shall state the following:
A. The name, address and telephone number of the person or organization seeking to conduct such parade;
B. The name, address and telephone number of the person who will be the parade chairman and who will be responsible for its conduct;
C. The date when the parade is to be conducted, and the time of day that it will start and terminate;
D. The location by streets of any assembly areas for such parade;
E. The route to be traveled, the starting point, and the termination point; and
F. The approximate number of persons, the approximate number of vehicles, and the approximate number of animals scheduled to participate in the parade.

9.16.035 - Indemnification; insurance.¶
Prior to the issuance of a parade permit, the applicant shall execute an indemnification agreement indemnifying the city from and against all claims, demands and liability on account of injury to persons and property of third persons arising from the issuance and use of such permit. Prior to the issuance of such permit, the applicant shall furnish evidence of public liability insurance protecting the applicant against all such claims, demands and liability and naming the city and an additional insured, in the form of a certificate of insurance, containing the agreement of the insurer not to cancel or modify such policy of insurance without at least thirty days prior written notice to the city. The amount of such liability insurance shall be determined in accordance with the requirements of the Monterey Bay Insurance Fund.

9.16.040 - Issuance of permit.¶
Upon receipt of an application conforming to the requirements of Section 9.16.030, the chief of police shall issue the parade permit to the applicant.

9.16.050 - Exclusions.¶
The provisions of this chapter shall not apply to any of the following:
A. Funeral processions;
B. Students going to and from school classes or participating in educational activities, provided such conduct is under the immediate direction and supervision of the proper school authorities; and
C. A governmental agency acting within the scope of its functions.

9.16.060 - Parking on parade route.¶
The chief of police may, when reasonably necessary, prohibit or restrict the parking of vehicles along a highway or part thereof constituting a part of the route of a parade. The chief of police shall post signs to that effect, and it is unlawful for any person to park or leave unattended any vehicle in violation of the signs. No person is liable for parking on a street in violation of this chapter if the street is not posted.

9.16.070 - Interference with parade.¶
It is unlawful for any person to unreasonably hamper, obstruct, impede or interfere with any parade or parade assembly, or with any person, vehicle or animal participating or used in a parade.

9.16.080 - Driving through parade.¶
It is unlawful for any person to drive a vehicle between the vehicles, persons or animals composing a parade when the vehicles, persons or animals are in motion and proceeding along a public street as a parade.
