15.01.010 - California Building Standards Codes adopted.

A. The city does adopt by reference the latest edition of the California Building Standards Code in publication at the time of adoption of the ordinance codified in this chapter. It is anticipated and expected that editions shall be from time to time amended, altered and changed to more recent editions. New editions published by the respective code organizations are automatically deemed adopted by the city for those building codes listed in this chapter. It shall not be necessary by ordinance or resolution by the city council to adopt alterations, amendments or changes in the building codes as they are promulgated from time to time.

B. The city building official shall be required to maintain copies of the Building Standards Codes listed in this chapter for review by the public and for administrative purposes by the city officials who have responsibility for the various areas for regulatory purposes.

C. Schedule of permit fees. The fee for each permit shall be as set forth by resolution of the city council.

D. Plan review fees. If it is determined plan review is required, a plan review fee shall be paid at the time of submittal of a building permit application. The plan review fee shall be sixty-five (65) percent of the estimated building permit fee as determined by the building official or his/her designee.

When submittal documents are incomplete or changed so as to require additional plan review, or when the project involves deferred submittal items, an additional plan review fee shall be charged as determined by the building official.

15.01.035 - Fire hazard severity zone adopted.

The City of Shasta Lake hereby designates the Fire Hazard Severity Zones as recommended by the California Department of Forestry and Fire Protection pursuant to Government Code Section 51178. The map shall be maintained on file with the office of the City Clerk, City Hall, 4477 Main Street, and at Shasta Lake Fire Protection District, 4126 Ashby Court.

15.01.120 - California Referenced Standards adopted.

The city does adopt the California Referenced Standards Code as published by the International Code Council together with all relevant appendices and amendments as adopted by the state of California.

15.01.130 - Uniform Housing Code adopted.

The city does adopt as its housing code the 1997 edition of the Uniform Housing Code as published by the International Conference of Building Officials, regulating and controlling the use and occupancy, location and maintenance of all residential buildings and structures.

15.01.140 - Enforcement and penalties.

A. The city building official is authorized and responsible for enforcing all building regulations adopted in this chapter. The fire chief of the Shasta Lake fire protection district or his or her designee shall be the principal enforcement officer with respect to the California Fire Code.

B. Any person who commences any work for which a permit is required before obtaining the necessary permits shall be subject to an investigation fee that shall be in addition to the required permit fee. The investigation fee shall be equal to the amount of the permit fee established by city council.

C. Any person who violates a provision of this Chapter or fails to comply with any of the requirements thereof or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents or directive of the building official or of a permit issued under the provisions of this chapter, shall be guilty of a misdemeanor for each day such violation continues. Any person violating the provisions of this chapter shall also be liable for civil penalties of not less than two hundred fifty dollars ($250.00) or more than one thousand dollars ($1,000.00) for each day the violation continues. The city attorney may seek civil penalties in any civil action brought to enforce any provision of this chapter.

15.01.150 - Applicability and effective date of building codes.

A. The provisions of this chapter shall apply to the construction, alternation, movement, enlargements, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such buildings or structures within the city.

B. Only those standards approved by the California Building Standards Commission that are effective at the time an application for a building permit is submitted shall apply to the plans and specifications for, and to the construction performed under, that permit.
