8.12.010 - Dangerous fireworks defined.

The term "dangerous fireworks," as used in this chapter, shall be the same as set forth in the Health and Safety Code, Section 12505.

8.12.020 - Prohibition.

It is unlawful for any person in the city to sell, offer for sale, give away, discharge or have in his or its possession or custody any dangerous fireworks, as defined in Section 8.12.010.

8.12.030 - Displays—Exemption from prohibition—Permit required.

The provisions of Section 8.12.020 shall not be held to apply to any person giving a display of fireworks in any public park or in any other open place within the city under and in accordance with a permit therefor issued and secured in compliance with the provisions of this chapter.

8.12.040 - Display permit application—Contents.

Any person desiring to give a display of fireworks in any public park or in any other open place within the city shall make a written application therefor to the council. Such application shall contain the name and address of the applicant, the place where such display of fireworks is to be made, the time at which such display is to be made and the duration of such display, a detailed statement setting forth the kinds and amounts of pyrotechnics to be used in such display, and the purpose for which such display is to be made.

8.12.050 - Display permit application—Issuance determination.

The chief of the fire department shall carefully examine and investigate each application made for a fireworks display and shall report to the council thereon. If, upon such application and report, the council shall find that the giving of such display will not be detrimental to the public health, safety and welfare, the chief of the fire department shall issue a permit for such display.

8.12.060 - Enforcement; penalties.

(a) The chief of police or his or her designee, upon determining a violation of this chapter, may issue an administrative citation, in accordance with Chapter 1.12, to the responsible party, person leasing or occupying the property or the property owner of where the firework was observed or discharged.

(b) The city council may establish an administrative fine for violations of this chapter by separate resolution.
