2.48.010 - Membership—Appointment.

The planning commission shall consist of five members, each of whom shall be appointed by the mayor with the approval of the city council.

2.48.020 - Membership—Restrictions.

Only electors residing within the city may be members of the planning commission. Neither an employee of the city nor elected or appointed officials may serve as a member of the planning commission.

2.48.030 - Membership—Term.

A. The members of the planning commission shall serve at the pleasure of the city council for terms of four years expiring on December 31, or until appointment of their successors, and subject to the right of removal of any member by a majority vote of the city council. Unexpired terms shall be filled for the remainder of the term in the same manner and under the same conditions as a full-term appointment.

B. Planning commissioners shall receive compensation in the amount of fifty dollars per month for every member of the planning commission, without regard to the number of city meetings attended by each planning commissioner.

C. Planning commissioners may waive their own compensation on an annual basis by giving written notice to the city manager after December 1 and prior to December 31 in the year immediately preceding the year for which compensation will be waived. For members appointed or elected to serve less than a full four-year term those members must give written notice of waiver no later than administration of the oath of office.

D. The compensation set forth herein shall become effective in the first full month after certification of the results of the November 6, 2018 municipal election by the Shafter City Council.

Each planning commissioner shall also receive a daily salary for meals and incidentals when traveling for city-related business. The amount of such daily salary shall be set by Ordinance 06-587. The daily salary shall be treated as wages, and will be subject to state and federal income and employment tax withholdings.

  1. Notwithstanding, Section 2.48.030.E.1, a planning commissioner who has made an annual election to waive his or her monthly salary pursuant to Section 2.48.030.C, shall not receive a daily salary for meals and incidentals when traveling for City-related business. Instead, he or she shall submit his or her expenses for meals and incidentals incurred while travelling for City-related business pursuant to the terms of Resolution 2640 (or its successor). Such reimbursements will not be treated as wages because they are made pursuant to an accountable plan.

F. The compensation set forth herein is exclusive of any amounts payable to each member of the planning commission for reimbursement of actual and necessary expenses incurred for city-related business.

G. Planning commissioners shall not be eligible for any health insurance benefits.

2.48.040 - Officers.

The members of the commission shall elect a chairman from among the members. Such chairman shall serve for a term of one year. Successors shall be appointed for like periods of one year from among the members of the commission. The commission may appoint such other officers from among its members as it may determine in accordance with the existing law.

2.48.050 - Meetings—Rules—Recordkeeping.

The commission shall hold at least one regular meeting each month. It shall adopt rules for the transaction of business and establish and maintain a written record of its resolutions, transactions, findings and determinations, which record shall be open to public inspection.

2.48.060 - Meetings—Absence.

A. Should a member of the planning commission be absent for three consecutive regular or special meetings of the commission or fail to attend eighty-five percent of the meetings of the commission during any twelve-month period, without having been excused by the body, the office of the member of the planning commission shall be deemed to be terminated. When a member of the planning commission is absent for three consecutive meetings during a twelve-month period, the secretary of the planning commission shall immediately inform the city council of the absence. The city council may request an explanation from the member before it reaches the decision of whether the absence was without cause.

B. An absence due to illness or an unavoidable absence from the city and written notice thereof to the secretary of the planning commission received on or before the day of any regular meeting of the commission shall be deemed absence for cause.
