10.48.010 - Purpose.

The provisions of this chapter are for the purpose of adopting bicycle regulations, under the authority of and in accordance with the provisions of Sections 21200 through 21207 of Article 4 of Chapter 1 of Division 11 of the Vehicle Code of the state and any future amendments thereto, and in addition to any other regulations provided by law.

10.48.020 - License and sticker—Required.

No person who resides within the city shall ride or propel a bicycle on any street or upon any public lane set aside for the exclusive use of bicycles unless such bicycle has been licensed and a license sticker is attached thereto as provided in this chapter.

10.48.030 - License and sticker—Application—Fee.

Applications for bicycle licenses and stickers shall be made upon forms provided by the city and shall be made to the city. An annual license fee of one dollar shall be paid to the city before each license is granted.

10.48.040 - License and sticker—Issuance.

The city, upon receiving a proper application therefor, is authorized to issue a bicycle license pursuant to Vehicle Code 39001.

10.48.050 - License—Denial.

The city designee shall not issue a license for any bicycle when he knows or has reasonable grounds to believe that the applicant is not the owner or entitled to the possession of such bicycle.

10.48.060 - License—Issuance—Inspection required.

The city designee assigned such responsibility shall inspect each bicycle before licensing the bicycle and shall refuse a license for a bicycle which is in an unsafe mechanical condition.

10.48.070 - Sticker—Issuance—Placement—Removal prohibited.

A. The city designee, upon issuing a bicycle license, shall also issue a license sticker bearing the license number assigned to the bicycle, the name of the city, and the period for which issued.

B. The city designee shall cause such license sticker to be firmly attached to the bicycle frame directly below the bicycle seat.

C. No person shall remove a license sticker from a bicycle during the period for which issued.

10.48.080 - Recordkeeping.

The city designee shall keep a record of the number of each license, the date issued, the name and address of the person to whom issued, the serial number and make, type and model of the bicycle, and all bicycle license fees collected by him.

10.48.090 - License—Transfer—Fee.

A license may be transferred when the ownership of such bicycle is transferred, and a fee of fifty cents shall be paid for the registration of such transfer. If such license is not made within ten days of date of transfer, then a new license will be required.

10.48.100 - License—Renewal.

Upon the expiration of any bicycle license, the license may be renewed upon application and the payment of the same fee as upon an original application.

10.48.110 - Dealers—Reporting requirements.

Every person engaged in the business of buying or selling new or secondhand bicycles shall make a report to the city of every bicycle purchased or sold by such dealer, giving the name and address of the person from whom purchased or to whom sold, a description of such bicycle by make, type and model, serial number thereof, and the number of the license sticker, if any, found thereon.

10.48.120 - Rental agencies—Restrictions.

A rental agency shall not rent or offer any bicycle for rent unless the bicycle is licensed and a license sticker is attached thereto, as provided in this chapter and such bicycle is equipped with the lamps and other equipment required by the provisions of this ordinance.

10.48.130 - Bicycle lane—Defined.

"Bicycle lane" means that portion of a roadway set aside for the use of bicycles and so designated as provided in Section 10.48.140. A bicycle lane shall consist of a lane for bicycles and pedestrians paralleling a roadway. Persons riding bicycles upon such lanes shall be subject to the provisions of prior code Section 10-16-19.

10.48.140 - Bicycle lane—Designation.

The city council shall designate, by resolution, those portions of roadways to be set aside and used as bicycle lanes.

10.48.150 - Bicycle lane—Use required.

Whenever a usable lane for bicycles has been provided adjacent to a roadway, bicycle riders shall use such lane and shall not use the roadway.

10.48.160 - Bicycle lane—Vehicles crossing.

No person shall drive a vehicle upon or across a bicycle lane except to enter a driveway and except to park such vehicle or leave a parking space. No person shall drive or cross a bicycle lane as permitted by this section except after giving the right-of-way to all bicycles within the lane.

10.48.170 - Riding on sidewalks.

A. No person shall ride a bicycle upon a sidewalk within a business district, and no person twelve or more years of age shall ride a bicycle upon any sidewalk in any district.

B. Any person who, by reason of physical disabilities, is otherwise unable to move about, shall be exempt from the provisions of subsection A of this section.

C. Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give an audible signal before overtaking and passing such pedestrian.

10.48.180 - Parking.

No person shall park a bicycle upon a street other than upon the roadway against the curb, or in a bicycle rack, or against a building, or at the curb in such a manner as to afford the least obstruction to pedestrian traffic. Where a parking rack is provided, no person shall park a bicycle at a location upon a public street or public sidewalk within a distance of one hundred feet from such rack.

10.48.190 - Administration and enforcement of provisions.

The police department is designated as the department of the city charged with the duties of issuing licenses, registering bicycles, collecting fees, and otherwise acting for the city as required of the city designee under the provisions of Sections 10.48.040 through 10.48.100, both inclusive, and is charged with the proper enforcement of this chapter and all its provisions.

10.48.200 - Auction sales.

Any unclaimed bicycle in the possession of the police department for six consecutive months or more after recovery as stolen property, impounding, or for other reason, shall be sold at public auction. The time and date of the auction sale shall be published in a local newspaper.

10.48.210 - Violation—Penalty.

Every person convicted of a violation of any provision of this chapter shall be guilty of an infraction and upon conviction thereof shall be subject to a fine as set forth in Vehicle Code Sections 39011 and 40000.1.
